McCain also said he doesn't trust Trump with potential SCOTUS picks either.

In either case, I would expect that kind of rhetoric from Ted Cruz, but not McCain.

I wish the USA was actually more united. Democrats and republicans are immature little brats! Crime is a big issue, gun control is a big issue, so is homeless, the roads and much much more. They can't compromise so stuff doesn't get done. So pathetic.

This points out an enormous gap in the constitutional framework of the United States.

The power of appointment is clearly vested in the Executive branch, and extends to the full range of administrative, judicial and military offices. But that power is held in check by the requirement of Senate confirmation.

So far, so good.

But what happens when the Senate, rather than exercising its power to confirm or deny appointments, instead begins to tread on the Executive branch's authority by stating that they will not act on the President's nominations (as they are doing right now, in fact), or when they prejudicially refuse to consider any nominees that do not meet their requirements?

McCain's suggestion is a deriliction of a constitutionally mandated responsibility. The Senate gets to say yes or no. But the Senate ought not properly to exercise that authority prejudicially. And the Senate ought not properly to refuse to exercise that authority.

But there is nothing in the Constitution that can compel the Senate. A glaring oversight.

I'm sure if they appoint a pro constitution judge the senate would approve. They won't approve Hilary gut the constitution judges as it's their job to defend the constitution

Part of the checks and balances is that the Senate is needed to approve a SCOTUS nominee, president does not make the decision by decree by design. If the GOP doesn't want to approve nominees then they shouldn't, they won control of the Senate for these very reason. Nothing in the constitution says that there have to be 9 justices, nothing says it has to be an odd number even, they could keep it 8 permanently or perhaps pass legislation which says the next opening will not be filled to bring it down to 7. GOP under no circumstances should capitulate on 1st and 2nd Amendment issues, they should use whatever tool at their disposal. Elections have consequences right?

Maybe, maybe not, looks to be pretty close. Depends on how voters punish backstabbers like McCain and Ayotte. In 2012 the senate races were way off so I wouldn't be surprised if that happens again.

The size of the SCOTUS is not set in the constitution so this has happened before, constitutionally this 100% okay and there is nothing that can be done about it.
