How does one conceptualize this event into a legal framework?

Is this a case of a horse being wrongly incarcerated as if he were a human?

Or is this traffic case?

Is the horse being impounded like an automobile due to the negligence of the horse's owner?

If it's the latter then it could be a precedent setting case!

Twentieth century cars could never get "spooked" by another car the way that horse got spooked.

But as we move deeper in the era of smart cars the day could come when your car gets a glitch in its hardware or software. And when you're shopping at Walmart your car could go ape out in the parking lot while you're away, and starting beating the crap out of another parked car just because the second car looked at your car funny!
