Autistic man held in custody for weeks 'after sticking two fingers up at the police'

Marcus Potter, who was diagnosed with autism when he was three, has a history of filming police officers, according to father Martin.

The 20-year-old's "obsession" developed around three years ago, and has apparently led to numerous appearances in court on charges of harassment.

On November 16, Mr Potter was en route to a Job Centre appointment when he is reported to have made a rude gesture at the Bethel Street police station in Norwich.

He was arrested at his home in Wymondham, Norfolk, the next day for allegedly breaching bail conditions previously imposed on him.

The police say Mr Potter consistently took part in anti-social behaviour and his actions often posed a threat to both the public and himself.

He has been held in custody in HMP Norwich ever since, with a hearing set to take place on Friday January 19.

He is allowed three visits a month and last saw his family on Christmas Eve.

His father, Martin, 58, told the Standard: "Marcus's autism is so profound, I can't believe the right thing to do is lock him up like this.

"He struggles day to day. He's not particularly independent...He would love to be independent but he just isn't ready yet.

"I don't want to lay all the blame at the door of the police because I know he has been a nuisance.

"But he has not had the support from social services he needs. My understanding is they just don't have the resources they need to give him proper care.

"He has constantly had to endure being mocked and bullied because he is different.

"He hates it in there and he wants to get out."

A petition launched, titled "Free Marcus Potter - Autism is not a criminal offence", has received close to 4,000 signatures.

It reads: "Marcus is an extremely vulnerable young man and his condition means he can be socially naive and fail to understand the implications of his behaviour.

"Marcus has been let down by various professional bodies and has received punishment where he should have received support.

Commenting on the case, a spokesman for the National Police Autism Association said: “It is important that individuals on the autism spectrum are dealt with appropriately according to their needs when coming into contact with the criminal justice system.

“Due to communication issues and difficulty regulating emotion, autistic people are vulnerable regardless of their age or station in life, and should be treated as such.

“Having autism is not an excuse for criminal or anti-social behaviour.

“However the NPAA advocate that there is a need for the outward traits displayed by many autistic people to be recognised by all criminal justice agencies, and for appropriate safeguarding measures to be put in place.

The criminal behaviour order is a necessary measure in order to ensure Mr Potter does not present a danger to himself or the general public through his actions.

"The CBO specifically precludes Mr Potter from making approaches to police officers unless in danger or reporting a crime and also not to film police officers or premises.


I have not read anything to suggest that Marcus Potter is a danger to anyone. I do not know British law but I can see what Potter does would be viewed as harrasment even though to me it is a special interest combined with lack of understanding of boundries.

I don't get this why the heck did they arrest this guy he,s not violent he didn't hurt anyone he was just filming the police. there nothing wrong with that and yes he was being socially unacceptable but he doesn't know any better especially that he,s so low functioning I can't even begin to the stress he's going through given that he probably doesn't understand what he did wrong he such be allowed to go home. I mean how can you arrest or punish someone who didn't know they did anything wrong he should go free I mean as long as he's not hindering the polices ability to work effectively I don't really see the problem besides it being annoying for the individuals on the police force but still people can be plenty annoying without evening having to be autistic . they such let he go and his maybe help him find a way to engage his interest without being disruptive to society and without putting himself in potential legal trouble or danger of harm.

Autistic man fixated with police must stay in jail as court rejects appeal

Mr Potter was handed a Criminal Behaviour Order (CBO) by magistrates after he was convicted of causing alarm and distress when he filmed police and members of the public on February 2017.

Prosecutor Oliver Haswell said the order had been amended by the court for Mr Potter to be able to understand it.

Dismissing the appeal, Judge David Radford said: “The CBO is helpful and is very clear to him.

“He knows exactly what it is that he is prohibited from doing.”

No court date has been set for his trial for breaching the CBO.

As many reading this story are fixated with Marcus and special interests (which we can relate to) His parent's faces (Martin and Ana Potter) show 20 years of stress looking after Marcus (which I suspect many of us parents can totally relate to)

The police are stuck because of their adherence to law. So it's up to the judicial system to separate risk to the public and risk of miscarriage of justice for Marcus and his parents. Basically jurisprudence is not being updated as there is simply no risk to the public from Marcus and policework isn't being obstructed if he is just filming "constable plod" eating donuts in their police van.

But does Marcus have access to a police radar? would he turn up to a police operation and interfere? that's the only concern I would have

His family are delighted to have him home and for the house to be noisy again. They are having a late Christmas meal to celebrate and are so grateful for everyone who played a part in the campaign. A special thanks to Richard Mylan for his invaluable support!

Marcus has a care plan in place including specialist mental health support and will receive support from probation services. The next hearing is listed for 16 February 2018.

Great news! Now, I hope that an advocacy group takes on the U.K. law which prohibits photographing police officers. Various U.S. courts considered photographing officers over the last several years. It is now largely resolved by our courts (photographing is legal on public property, but a reasonable distance may be provided temporarily to aid emergency workers doing their jobs). Let's hope for the same from U.K. courts.

It's not illegal to photograph the police in the UK. He was put in prison for breaking the order. These orders are very effective for keeping people out of prison but only because if you break them you're in serious trouble. He shouldn't have been given the order in the first place. The real problem here is that it's the police dealing with him, which is not what they want. He seems to have been under the influence of someone who gets youtube money from posting vids of Marcus harassing the police. This is not coming from the police but from other police watchers on youtube.

It seems to have started off in a more 'special interest' way with 104 requests for freedom of information including one to Norwich City Council wanting to know their contingency plans in the event of an alien invasion but it has gone off into a more confrontational path. He needs more support than his parents, the job centre and the police, hopefully now he might get that.

I film the police all the time here in Texas.. I have my camera in my car wherever I go and if I see some type of incident, I'll find a place to park and begin filming and getting different shots of the cars with the lights on, the Officers doing what they're doing, and just a bunch of different stuff.

I know here we have the first amendment right which is freedom of press, meaning as long as you are on public property you can film what you can see and your eyes can't be trespassed. Although sometimes I've been on private property and filmed but no one has said anything, and if they asked me to stop of course I would stop and relocate to public property so I can continue.

I have a good relationship with my cities police department and all the times I've been on scene of a call they'll wave, ask how I'm doing, etc.

Glad he was released!

I don't think that man should have been arrested. He was following his passion. I can see how some people would find that to be cringe worthy, but he wasn't harming anybody.
