Trump calls on GOP state legislatures to overturn election results by Kyle Cheney, Politico, 11/21/2020.

Quote:
President Donald Trump made explicit Saturday the strategy his legal team has been hinting at for days: He wants Republican-led legislatures to overturn election results in states that Joe Biden won.

...

Trump's comment came after a string of legal defeats, including a rejection by a federal judge in Pennsylvania Saturday who said the Trump team presented no evidence of election fraud or misconduct, despite seeking to invalidate millions of votes.

...

... Trump's options have narrowed and he is becoming increasingly reliant on longshot scenarios where election results are not certified and Republican-controlled statehouses in Pennsylvania, Michigan, Arizona and Georgia intervene to declare him the winner.

...

To succeed, Trump's plan would require several unprecedented legal steps. First, Republican-led legislatures in states Biden won would need to move to overturn their state's popular vote and appoint a slate of Trump electors when the Electoral College meets on Dec. 14. In Pennsylvania and Michigan, such maneuvers would be certain to meet vetoes from Democratic governors, so the lawmakers would also need to secure a legal determination that they hold the sole power to appoint electors — a disputed legal premise that has never been tested.

Luckily it appears that, so far at least, Republican state legislators are not going along with this idea.

Those GOP legislators seem to understand the sheer lunacy of disenfranchising millions of actual voters to satisfy Mr. Trump's delusion that a few imaginary voters were denied their right to vote.

D-minus 58 days, and counting...

Trump and many of his supporters are trying various tactics to either delay the certification of election results or overturn them. For example: Key GOP Michigan canvassing board member expected to vote against certifying results (CNN, Sun November 22, 2020).

Possible, but not very likely this year, thanks to a recent relevant Supreme Court decision.

Apparently Trump's strategy is to try to create enough doubt about the validity of the election results that he can then either:

(1) pressure state legislators in battleground states to pick their own slates of electors based on what they think the results would have been without the alleged tampering, or

(2) delay the certification of election results past the deadline for choosing electors, thereby taking the system into legally untested territory where even more fun will begin.

See:

- Trump's 'Death Star' strategy: Forcing a fight over states' electors By Jonathan Turley, opinion contributor, The Hill, 11/21/2020

- The Election That Could Break America by Barton Gellman, The Atlantic, November 2020: If the vote is close, Donald Trump could easily throw the election into chaos and subvert the result. Who will stop him?

(The latter article was written back in October. Fortunately, some of the possible election day scenarios the author discussed did not come to pass, e.g. there was not anywhere near enough violence on Election Day to justify a declaration of martial law. But the U.S. electoral system has many legal loopholes that Trump and his attorneys could conceivably try to exploit. It remains to be seen how many of them they will try.)

Republicans sue to stop Wisconsin vote certification by Scott Bauer, AP, Nov. 24, 2020

Quote:
MADISON, Wis. (AP) — Republicans filed a lawsuit Tuesday asking the Wisconsin Supreme Court to block certification of the presidential election results even as a recount over President-elect Joe Biden’s win over President Donald Trump is ongoing.

The lawsuit echoes many of the same arguments Trump is making in trying, unsuccessfully, to have tens of thousands of ballots discounted during the recount. It also seeks to give the power to name presidential electors to the Republican-controlled Legislature.

...

(Emphasis mine.)

In other words, Trump wants the Wisconsin election results to be completely disregarded in favor of the legislature itself choosing the electors.

Trump's trip to Pa. canceled after Giuliani exposed to coronavirus

Quote:
Reporters traveling with President Donald Trump were told late Wednesday morning that Mr. Trump's trip to Pennsylvania has been canceled. The cancellation came after the president’s personal lawyer, former New York City mayor Rudy Giuliani, was exposed to a second person who tested positive for COVID-19 in the last week, according to media reports.

The president was set to attend the event in Gettysburg, where Republican state lawmakers of the Senate Majority Policy Committee were to discuss allegations of fraud in this month's election.

Rudy Giuliani wants lawmakers to seize Arizona's 11 electoral votes. Is he nuts? by Laurie Roberts, AZ Central, Nov. 30, 2020: "Opinion: Republicans are just embarrassing themselves by their continued insistence that Arizona's election was stolen from Donald Trump."

Quote:
The Great Arizona Quest to Uncover a Conspiracy continued on Monday as nine Republican legislators convened a “hearing” into voter fraud in the state’s election.

Trump lawyer Rudy Giuliani urged the Republican-run Legislature to throw out the results of the election and seize control of the state’s 11 electoral votes.

Hopefully this won't pass. But if it does pass, Arizona Republicans will be doing more than "just embarrassing themselves," alas. If this succeeds in Arizona, Trump and his all-too-many fanatical followers will be able to step up the pressure on other Republican state legislators in battleground states to overturn their elections too.

Pennsylvania Lt. Gov. Fetterman: Congressman's lawsuit could quash attempt by state lawmakers to pick pro-Trump electors by Delphine Luneau, The Center Square, Nov 28, 2020:

Quote:
(The Center Square) – Pennsylvania Lt. Gov. John Fetterman argued Saturday that any attempt by state lawmakers to reconvene and vote for a new slate of electors favoring President Donald Trump would be doomed to fail – ironically, because of a lawsuit filed by a pro-Trump lawmaker.

Republican U.S. Rep. Michael Kelly’s lawsuit argues that a 2019 law that allowed widespread mail-in balloting in Pennsylvania was unconstitutional, and that 2.6 million ballots should be thrown out as a result. That would erase the 80,000-vote lead of presumed President-elect Joe Biden and give Pennsylvania’s 20 electoral votes to Trump.

A commonwealth court judge this week granted an injunction to Kelly and his co-plaintiffs ordering that no more voting results be certified by state and local election officials. Secretary of State Kathy Boockvar had already certified the presidential race, on Nov. 24, but none of the down ballot races had yet received certification.

...

Thus, Kelly’s lawsuit, discussed here, delays the possible start of the new Pennsylvania legislative session. If delayed long enough, this will prevent the Pennsylvania state legislature from having a chance to vote on any resolution to overturn the presidential elections before the Electoral College meets.

And indeed: Pennsylvania House GOP leaders: Lawmakers won't meet again this year by Delphine Luneau, The Center Square, Nov 29, 2020:

Quote:
The Republican leaders of the Pennsylvania House of Representatives announced late Saturday that they will not be returning to session this year, a move that would appear to preclude any possibility of lawmakers interceding in the 2020 election.

House Speaker Bryan Cutler, R-Quarryville, and Majority Leader Kerry Benninghoff, R-Bellefonte, released a joint statement saying that they would not be calling their chamber to Harrisburg on Monday, the final possible day for the 2019-20 session of the Legislature to meet.

“We are physically unable to consider any new legislation before the end of session,” they wrote in the statement. “A simple resolution takes three legislative days for consideration and a concurrent resolution takes five legislative days to move through both chambers, which means we do not have the time needed to address any new resolutions in our current session.”

Here I was mislead into thinking the Republicans were the opponents of the Democratic Party, not of democracy itself.

These attempts are desperation on Trump's part and won't go anywhere because most Republicans are not insane enough to go along with this.

I believe you're right when it comes to elected Republican officials but I'm not so sure about the average GOP voter.

Since the election, surveys have consistently found that about 70 percent to 80 percent of Republicans don’t buy the results. They don’t agree that Joe Biden won fair and square. They say the election was rigged. And they say enough fraud occurred to tip the outcome.

I'm not willing to count on their sanity when it so often appears to be utterly lacking. I hope to be proven wrong though.
