The Ontario case remains a definitive statement of the law in that province, and influential in every other. It has been followed in BC and Saskatchewan, which makes it very likely that courts in every other jurisdiction would respect it as good law.
Now, the moment that a court comes down with a different judgement--or the moment that Parliament amends section 173, then my opinion would necessarily change. But as of this date neither of those things has taken place, so I am sure that women are free to go topless in Canada.
