Two former students of the Manitoba School for the Deaf are suing the province.

In the suit, filed Sept. 30 in Court of Queen's Bench, the students allege they were physically and sexually assaulted and harassed by staff and classmates for years.

The two women, now in their 40s, attended the school in the 1970s and 80s.

The allegations have not yet been proven in court. A statement of defence has not yet been filed by the government.

The school, located in Winnipeg, teaches both elementary and secondary students and offers both residential and day programs.

One of the women alleges she was sexually assaulted on numerous occasions.

The second woman alleges that during a weekend visit to a staff member's home, she and other girls were put in dog cages and deprived of food and sleep.

The lawsuit also claims deaf students were prohibited from using American Sign Language in class and were punished for it.

It also states the province forced deaf students who attended the residential school to be cut off from their families.

The claim seeks a court order certifying the case as class action.


If this legal action is successful, then it will set a precedent in regards to the limitations period as well as the extention of 10 years upon discovery exemption clause.Although it is still going through the courts, if successful, it will be a good precedent for those who wee bullied and abused years ago in school, to use as a case law argument.That means it will also apply to autistics, aspies, and others who suffered abuse and bullying years ago should they choose to take legal action against their tormentors.

the statement of claim was filed on Sept 30.The government has only a little bit of time left to file a statement of defence and if they don't, the plaintiffs can get a default judgment or file a note in default, in their favour.

The government has 15 business days after the day of service, to file a statement of defence.

ALBERTA RULES OF COURT




142(1) If the defendant has failed to file a statement of defence or demand of notice, the plaintiff may on proof by affidavit that the statement of claim has been served, having regard to the nature of the claim.

(a) enter final judgment against the defendant, or
(b) on praecipe require the clerk to enter in the procedure book a note to the effect that the defendant is in default.
