Millionaire faces jail for attacking intruder

A millionaire in the UK faces life in prison for attacking a robber who held him and his family at knife point, a story by the Telegraph.co.uk said.

Munir Hussain, 52, was found guilty of "inflicting grievous bodily harm with intent," for attacking Walid Salem, 56, one of three raiders who broke into his house and forced him, his wife and three children to lie on the floor with their hands behind their backs. At some point they were able to overtake Salem, and neighbors say they saw "several men" beating him with weapons including a cricket bat and a metal pole.

Salem was left with injuries including a fractured skull and bruising on the brain. In another twist, Salem could be eligible for criminal injury compensation, even though he recovered to commit other crimes.

Man, even Califiornia isn't that bad when it comes to self-defense laws.

Have already been jury awards similar to that in news in decades past.

Salem does not deserve any compensation. He broke into a family home with malicious intent.

Found original article and ya gotta love this:

Quote:
A millionaire businessman is facing jail for attacking a career criminal who had held his family hostage at knifepoint.

Munir Hussain, 52, was told he would be killed when three raiders invaded his home.

He and his wife, their teenage daughter and two sons were ordered to lie on the floor of the living room with their hands behind their backs.

The Government has promised that people who fight back against burglars will find the law is on their side, so long as they do not use excessive or disproportionate violence.

Last year's Criminal Justice and Immigration Bill contained clauses to protect them from prosecution if they act instinctively and out of fear for their safety.

Justice Secretary Jack Straw said: 'Law-abiding citizens should not be put off tackling criminals by fear of excessive investigation.

'For a passer-by witnessing a street crime or a householder faced with a burglar, we are reassuring them that if they use force which is not excessive or disproportionate, the law really is behind them.'

The man "was told he would be killed".
WOULD be killed.
It WOULD happen.

"Would" is not the same thing as "maybe", is it? Someone do tell, I'm not sure now.

So, tell me just what exactly is 'too much force' to use against someone who declares he's going to effing KILL YOU :?:

Oh, wait, I know, you have a knife to my throat so I'm going to make you sit in the corner for "Time Out" because you've been a bad boy.

Jeeeeeezzzusssss Christ.

At least THEY were apparently wise enough to not break the law by defending themselves.
Unlike that other guy.

The 'mummy's boy' held after his parents are knifed to death at home he refused to leave

The son held over the brutal murders of his retired teacher parents was a 'Mummy's Boy' who had refused to leave home despite being in his mid 30s, it emerged last night.

Daniel Dighton was found hiding in the attic by police after they discovered the bodies of his father Barry, a former prep school headteacher, and his mother Elizabeth, at the family's home in Croydon, South London.

Mr and Mrs Dighton had suffered stab wounds and been subjected to an 'appalling frenzied attack', sources said.

While the exact extent varies, most (if not all) states have laws that specifically allow home defense. In some you can kill any intruder, in others it's more specific as to what they have to do, but once you've been threatened in your own home, you can kill the person.

My father has always told me that if you have to defend yourself, be prepared to kill the person. Otherwise the attacker might turn around and sue you. If they're threatening your life, it's better for them to die right there.
Of course, if you're armed, it doesn't take much force at all to kill somebody.

In the USA, it's a tricky defense. The concept is called 'imminent danger'. You have to prove that you were going to die if you didn't act. It doesn't always work, even here.

It were not always thus. Up until 1980 in Massachussetts the law said one had a duty to retreat if threatened with deadly force, even an invasion in one's own home. Fortunately this has been changed.

They ought to change it and make defence of yourself and your family in your own home absolutely unlimited. Then the criminals might think twice.

The UK is a screwed up blame-the-victim surveillance state. I feel sorry for my relatives there...

Hold on a minute. I took a look at that story. Apparently the robber was in the process of trying to escape when he was caught, then taken to the garden and beaten up with weapons including a cricket bat and a metal pole. At that point, it is no longer self defense under the law.

Yes you have the right to defend yourself but when the person breaks off the attack and tries to flee you are legally not allowed to pursue him and continue the attack.

Yes, that's my impression of it. I think there's a grey area, because for many people the point at which you become safe is not the point where the assailant momentarily stops attacking, but where they become unable to attack. I'd say it was reasonable to continue to inflict injury on someone stronger than yourself until you were sure they wouldn't be getting up again, but not to continue to inflict injury as retribution. Whether this particular case was over that line, who knows?

It has to be defense. All the bullet holes have to be in the front.

Some states in the USA have whats called a castle law. If someone breaks into your home (AKA castle), you have the right to make the person leave by anymeans. If this includes killing him, so be it. He is invading your home.
