Finally!

Now coverage will be decided on a case-by-case basis for Medicare recipients.

The ruling itself can be found here, though it has not yet been posted on the HHS page:

That's very good news. All I have to do is move down to the States. :)

Isn't it strange that sometimes the Law has to step in to ensure logic and reason?

Wow, had no idea that was even being reconsidered. Hope Janice Raymond is very perturbed by it. And also hope it helps your situation, benficii.

The original decision was basically a 'fix.' The committee chose as their expert someone who was known to have extremely anti-trans views (and had written a book demonstrating that). And, so they got the anti-recommendation that they wanted. They didn't break any rules, but weren't doing their jobs in good faith, either. Or, at least that's the story I've heard about it.

I wonder if the Republicans would try to overturn this decision, by categorically excluding coverage of sex reassignment surgery by Medicare by statute, or heck! even requiring such categorical exclusions in any and all federally funded plans (which would include just about every plan except for those under ERISA). If the Republicans take over both Houses of Congress this year, would Obama compromise this coverage away, with a bill singling sex reassignment surgery out? (As for the bill itself, its name would be Legion: For they are many sections on many different subjects.) Obama would look reasonable (but not actually be reasonable) by signing such a bill into law, because after all, sex reassignment surgery isn't really that necessary for anybody, say most Republicans and many Democrats, and because deficit.

I just told my gay paternal uncle about this decision and he warned me that I needed to take advantage of this fast, before the Republicans returned to power! Only thing is, I'm not on Medicare.
