Quote:
He said Jackie Lang, aged in her 30s and who worked full time at the restaurant, was confronted by management two weeks following the incident.

Quote:
"They are allowed endless amounts of soft drink if they work there. Her friend came in all upset and distressed, so Jackie took a break, poured a drink and sat down with her," he said.

Quote:
Ms Lang said she shared her free diet cola with a friend while consoling her over a personal crisis and was told that the police had been contacted over the ‘theft’.

That above link has audio but I can not play it. We need pictures to make this story real for the fence sitters.

Quote:
According to the Autonomous Workers Union, Ms Lange shared her free staff drink with an upset friend who arrived at the George Street Subway in Dunedin.

Store address.

If there has been or will be TV story on it I assume Channel 9 in Dunedin NZ will have but no sign if its available online.

Like others have mentioned Subway is a franchise, in fact a friend of mine is the manager at the local store. I find them handy when travelling but rarely go to the one in town.

I've been to a number of Subways in New Zealand on holiday but don't think I went to the one in Dunedin when I was there. The fastest sandwhich maker I've ever seen was a lady at the Subway in Thames, New Zealand. I'm certainly not going to boycott an entire global chain (I've been to one in Mainz, Germany as well) just because of this one pinhead manager.

Talk about an overreaction!

Criminal charges over a cheap drink that she was allowed to have in the first place?

I honestly think she'll be ruled innocent, then she has more then enough justification for a discrimination lawsuit, or at least a wrongful dismissal lawsuit. And I honestly hope she wins and single handedly forces that particular subway out of business, and the manager will never manage a store again.

This is a ridiculous over the top reaction even if the girls friend was supposed to buy her drink I beleive that her managers would have been better simply explaining to her and warning her not to do it again. If need be writing it down so she doesn't forget in future. Sacking and calling the police is f***ing stupid IMO.

I sent in a feedback message:
"Hey guys I heard about you firing that girl with Asperger's Syndrome for sharing a Coke.
I wanted to tell you that I believe it was a fantastic PR move.
I think the crime of sharing Coke ought to be fuly punished to the extent of the law...and beyond.
Why not punish her in a way that not only will alert her to her offense BUT cause her traumatic stress well in excess of what neuro-typical functioning people will feel?
Make her chances of gaining employment incredibly hard (never mind the fact that is is hard because of her condition).
Drive her self-believe in her attempts to socialise and integrate into the ground.

Hang on you have already done this.....but she deserves it of course!

Or does she? Was it actually picking on a marginalised person in society, who is vulnerable to misreading social conventions.
Might a spelling out of the policies have been a little more appropriate in this circumstance, and ruining a marginalised person a bit too much?

If this is so then surely SUBWAY is a despicable uncompassioante employer and has branded itself by its own actions as a socially irresponsible corporation.

I will help put the story out for you, to see what other people think....Hope you don't mind."

What do ya reckon?

Good Letter. Maybe their new marketing campaign will be "Subway where NT bullies come to get fully"

It was really unfair to fire people for such excuses... what makes it more unfair is that this was the lady's first "mistake"! Other people who make mistakes might finally JUST get a demotion.

Either the manager had something against the woman and AS or either he needs psychotherapy and logic teaching classes.

Nothing adds up here. I'll put money on him not liking the girl (because of Asperger's or something else) and just wanting to get rid of her.

It mentions the Subway store went to the police after she filed a grievance case. So basically the store used the typical old fashion labour breaking technique of using jack booted thugs (police in this case) to intimidate workers in not exercising their rights as workers.

TheMachine1, you should read the blog I added, seems like they violated all kinds of employment rules. either way though, it stinks!

Quote:
You may not hold a disciplinary meeting with a staff member without advising them of the nature of the meeting and you must allow them time to get representation if they desire it.

Secondly employment law requires that staff are given the opportunity and training required to correct their faults unless it is “serious misconduct”.

I agree with the people on here that probably the Coke was just an excuse to fire someone they wanted out of there anyway, possibly due to Aspie behavior that they found unnerving. I worked at Wendy's one summer, and they were never that anal about policies. We were supposed to pay half-price for the food we ate, but if we were working a long shift with no break and got hungry, we would sometimes pop nuggets or whatever in our mouths to tide us over. Management never had a problem with that. I can't imagine how unpleasant it must have been for her to work there with managers like those.

One of my freind's brother gets free food at wendys and he is allowed to give it over to my freind for tomnmorow's lunch. Yeeeeesh, I thought it was a fast food industry standard to allow peoplke to gicve a couple free otems to friends.
