Actually, I'd say that Thomas is that rare perfect example of the old "colorblind" model of race relations, the irony being that he gets attacked for not favoring his own race. I find his devotion to the law as written both admirable and infuriating in just about equal measure, but I'd never accuse him of any sort of racial bias, as he's equally harsh to everyone.

he was the beneficiary of an affirmative action program as a law student but he opposes similar dispensation for other black folk. how can anybody say that is not DIS-favoring his own race?

That's not uncommon, a young man takes advantage of an opportunity that his older self comes to regret as unseemly, or that he thinks provides the wrong incentives. I know I'd be ashamed to directly benefit from my race, plenty of people seem to feel pretty guilty about even indirect and unsought racial benefits.

it still seems like a kind of hypocrisy that says "i'll take this benefit but i'll work to deny it to you because I think you are not deserving of it and need to work harder." it does not SOUND very good! it is like climbing the ladder of success then pulling it up right behind so nobody else may follow.

Again, easily explained by changing attitudes as someone ages. Black linguist John McWhorter described similar feelings in his book Losing the Race, saying that he felt cheated of the opportunity to prove himself on a level playing field and that his degree came to feel somewhat illegitimate to him due to his use of affirmative action in getting into school.

He sold his soul for an ideology which has been at odds for the cause of racial equality. That ideology is now more important to him than the color of his skin, or the history that comes with it.
