Laws don't matter, facts don't matter. The jury decides all that.

I thought the judge decides on the compensation?
The jury is given a checklist.
A. Was the defendant negligently defamatory .... blah blah blah (Kentucky specifically as a lower standard)...?
B. Enter Actual Damages
C. Was the defendant grossly defamatory .... blah blah blah?
D. Enter Punitive damages
The jury can do whatever they want.
It's very emotional. These are random people off the street.
If they want, they can enter in 10 billion dollars actual damages, and 100 Billion in punitive damages.
That's why this being in "MAGA Country" Kentucky matters.
In one of my civil trials, the jurors knew the lady defrauded an insurance company, however, they were like "F*CK" this insurance company, and decided to give her money anyways.
Facts don't matter, law doesn't matter. The jury can do whatever they want.
So, you see, WAPO and CNN trying to stop this before it gets to a jury.

They do in small claims cases under $5,000 to $10,000 depending on who is suing who/what.
Such cases usually don't involve being represented by an attorney.

Any grossly ridiculous level of damages would likely be overturned upon appeal.

CNN settles $275M lawsuit with Covington Catholic student Nick Sandmann
A CNN spokesman confirmed to The Washington Times that a settlement had been reached, but offered no details. The amount was not disclosed in federal court in Covington, Kentucky, according to Fox19 in Cincinnati.
The teen’s family filed lawsuits against CNN, NBCUniversal and the Washington Post over reporting on the January 2019 incident in which Nicholas was filmed standing face-to-face with Omaha elder Nathan Phillips as he played a drum on the steps of the Lincoln Memorial.
Sandmann attorney Todd V. McMurtry declined to comment on the settlement with CNN, but said attorneys agreed in a conference with the judge to “proceed with haste” in bringing in as many as 12 additional media outlets as defendants.
“The case against NBC and the Washington Post continues, and there are a number of additional defendants that we will be suing over the next 30 to 60 days,” said Mr. McMurtry, adding, “The defendants are those that republished Nathan Phillips’s false statements.”
Attorneys for the Sandmann family accused the network of “bullying” the Covington Catholic High School student, who wore a red Make America Great Again ball cap, to push a political agenda, which CNN has denied.
U.S. District Court Judge William O. Bertelsman initially dismissed the case against the Washington Post, but reinstated it in October

Depends on who you ask. Cyberdad used that in the original post to describe the student who at the moment he was filmed in his heinous offense of smiling at someone who was in his face chanting (/s) was wearing a hat with Make America Great Again on it. Cyberdad is not particularly fond of conservatives and/or people who take religion seriously enough to allow it to change the way they act. This student was both, and to add the cherry on the unpopularity sundae, he was at the National March for Life, a massive antiabortion rally (which I have attended back in 2013 seeing a crowd of 640,000. It has grown considerably since.)
"Racist bigot?" Well, I don't know the kid personally. But considering his name and face have been slandered all the way around the world because he had an awkward reaction to an awkward situation, I think it is in the benefit of all people, Aspie or NT, that he be awarded something in settlement. There should not be any more consequences tacked onto the embarrassment of an awkward conversation with someone who disagrees with us. Besides, if teenagers can't be gauche, then it's left up to our elected officials.
