It does sound like a cash grab but the merits of the case are strong. If they didn't have written permission or consent to publish a photo of a naked child on their album cover, and the family got no compensation ... they're screwed. Where I live you can't even print photos of your own newborn undressed. Plus, if it's true they threw this boy in the water to get that expression? WTF

I agree it might be thrown out because they waited too long, but it sounds totally illegal to me.

It would open a massive can of worms to the hundreds of thousands of babes used in commercials, TV dramas and movies over the last 50 years. If he succeeds then he would open the floodgates for others to use his win to get their share of compensation.

The parents were paid $200 for the photo at the time, so the family was compensated. The parents agreed to this arrangement. This information comes from a NY Times article. If anything, he should be mad at his parents. Maybe he can sue them next.

Seriously, I know his story, it was a celebrated part of his life, right up until the money ran out, apparently.

Looks like somebody knows the laws.
There is that law for child exposure, in America which might be in other countries too, I think Romania has that too more recently.
Why are the parents acting like theyve been misled though? Were they not told what the pic was gonna be used for? What if a creep comes up to them to ask for kid pictures? xD Or they recognized the band?
