US Capitol Police arrest Stephen Colbert staffers at House office building, charged with illegal entry

The U.S. Capitol Police arrested a group of staffers with CBS's "The Late Show With Stephen Colbert" after they allegedly illegally entered a U.S. House of Representatives office building on Thursday night, Fox News has learned.

The group of nine people were arrested in the Longworth House Office Building after being escorted out of the Jan. 6 committee hearing earlier in the day because they did not have proper press credentials, according to sources.

The same group resurfaced later on Thursday night after the Capitol complex was closed to public visitors and Fox News is told that they took videos and pictures around the offices of two Republican members of Congress, Minority Leader Kevin McCarthy R-Calif. and Rep. Lauren Boebert, R-Colo.

The group was unescorted and charged with illegal entry to House office buildings after hours.

Robert Smigel is known for being the voice of Triumph the Insult Comic Dog.

The U.S. Capitol Police told Fox News in a statement that it received a call for a disturbance in the Longworth House Office Building at 8:30 p.m. on Thursday and said that additional charges could be filed.

Stephen Colbert's 'Late Show' crew will face no charges following Capitol Hill arrest

Federal prosecutors said Monday they have declined to bring charges against nine people associated with CBS' "Late Show with Stephen Colbert" who were arrested in a building in the U.S. Capitol complex last month.

The decision, made by the U.S. attorney's office in Washington, comes after prosecutors determined they "cannot move forward" with the misdemeanor charges against the nine people arrested June 16 in the Longworth House Office Building. The incident followed the third public hearing by the House panel investigating the Jan. 6, 2021, Capitol insurrection.

A spokesman for the U.S. attorney's office said it was not probable a conviction could be obtained and sustained given that the nine arrested had been invited and that their escorts had never asked them to leave the building.

Police said the group was arrested on unlawful entry charges "because members of the group had been told several times before they entered the Congressional buildings that they had to remain with a staff escort inside the buildings and they failed to do so."

Prosecutors said the group had been invited by congressional staffers and had never been asked to leave by the staff members who had invited them. The U.S. attorney's office said some people in the group of nine had been told by police that they were supposed to have an escort.

"The Office would be required to prove beyond a reasonable doubt that these invited guests were guilty of the crime of unlawful entry because their escort chose to leave them unattended," said Bill Miller, a spokesman for the U.S. attorney's office. "We do not believe it is probable that the Office would be able to obtain and sustain convictions on these charges."

They were right to not proceed on the charges. (By the way, the prosecution theory of the case would have required that they prove a non-following an order to leave).

I checked the statute in question. They were always invited in. Each time, however, the person inviting them broke the internal rules and left them unattended. The Capitol Police were mad because they were left unattended, they made them leave, they were re-invited, and it happened again.

The intersection between the private rules of a building and the public criminal law lends to confusion which is why normally the common law considered such matters a purely civil matter and not a criminal matter.

The most serious issue with the Capitol so-called Insurrection is that it was a riot, not that people were wandering in the wrong places.

and? what did they do to get arrested? is it a case of being in the wrong place at the wrong time.?
