Lake refuses to concede in Arizona governor’s race she lost

Refusing to concede, Kari Lake, the defeated Republican candidate for Arizona governor, said Thursday she is assembling lawyers and collecting evidence of voters having trouble casting ballots on Election Day as she considers her next move.

Lake, who was endorsed by Donald Trump, traveled to the former president’s Mar-a-Lago club in Florida on Thursday, her campaign spokesman told The Associated Press. The Washington Post first reported that she attended a luncheon held by the America First Policy Institute, an advocacy group created by former Trump advisers.

In a 2 1/2-minute video, Lake made no mention of giving up in her most extensive public comments since losing the election. Before the election, she had refused to say that she would concede if she lost the race to Democrat Katie Hobbs.

“Rest assured I have assembled the best and brightest legal team, and we are exploring every avenue to correct the many wrongs that have been done this past week,” Lake said. “I’m doing everything in my power to right these wrongs.”

She pointed to long lines at some polling places that were exacerbated by problems with ballot printers at about a third of the vote centers in Maricopa County, the largest county in the state. She said the problems disenfranchised voters who couldn’t wait at the polls.

County election officials said that all ballots were counted and that voters could go to any polling place in the county, many of which had little to no line, with wait times posted online.

Election officials traced the problems to a printer setting that sometimes led to ballots printing too lightly for the on-site tabulators to read. They said they used the same settings in the August primary and for pre-election testing and there were no widespread issues.

About 17,000 ballots were not scanned at precinct-based vote counters and were instead placed in a collection box to be counted by more sophisticated machines at the county’s election headquarters. The collection box has come to be known as “box three.”

Bill Gates, the Republican chair of the Maricopa County Board of Supervisors, has blamed state GOP chair Kelli Ward and other prominent Republicans for causing delays and long lines because they told their supporters not to use box three.

“This team, we have accepted our responsibility in this,” Gates said Monday. “But I’m not willing to accept responsibility for issues that were caused by others. And it is clear to me that those lines were longer because leaders in one political party were spreading misinformation.”

Republicans asked a judge to extend the hours at polling places because of the issues. The judge declined, saying they presented no evidence anyone was disenfranchised.

Democrats voted overwhelmingly via ballots received in the mail. In-person Election Day votes heavily favored the GOP because Lake and other prominent Republicans had claimed it was more secure, which election experts dispute.

On Wednesday, Lake posted a nearly two-minute video showing footage of her on the campaign trail. There was no audio in the video, other than Tom Petty's song "I Won't Back Down."

The estate tweeted Thursday night that numerous fans brought the video to their attention.
"This is illegal," the tweet said. "We are exploring all of our legal options to stop this unauthorized use and to prohibit future misappropriations of Tom’s beloved anthem."


Lake is an outlier. Most of the other MAGA candidates that lost have conceded.

Arizona judge rejects Republican Kari Lake's challenge to gubernatorial election

An Arizona judge has ruled against Republican Kari Lake's challenge to the result in the November gubernatorial race where Democrat Katie Hobbs was declared the winner by roughly half a percentage point.

In a decision Saturday, Maricopa County Superior Court Judge Peter Thompson, who was appointed by then-Republican Gov. Jan Brewer, found that the court did not find clear and convincing evidence of the widespread misconduct that Lake had alleged had affected the result of the 2022 general election.

The judge rejected Lake's claim that problems with ballot printers at some polling places on Election Day were the result of intentional misconduct.

The judge said Lake’s witnesses didn’t have any personal knowledge of intentional misconduct.

"The Court cannot accept speculation or conjecture in place of clear and convincing evidence," Thompson said.

In the ruling, the judge acknowledged the "anger and frustration" of voters who were inconvenienced in the election but noted that setting aside the results of an election "has never been done in the history of the United States."

Lawyers for Lake focused on problems with ballot printers at several polling places in Maricopa County, home to more than 60% of Arizona’s voters.

"My Election Case provided the world with evidence that proves our elections are run outside of the law," Lake tweeted. "This Judge did not rule in our favor. However, for the sake of restoring faith and honesty in our elections, I will appeal his ruling."

Katie Hobbs seeks sanctions against Kari Lake after Arizona judge dismisses election challenge lawsuit

Democratic Gov.-elect Katie Hobbs and Maricopa County filed for sanctions Monday against Republican Kari Lake, less than 48 hours after a judge ruled against Lake's efforts to have herself declared the winner of Arizona's governor race.

Hobbs and the county asked for sanctions against Lake and her legal team after an Arizona judge denied Lake's bid to reverse the results of the November election in a two-day trial.

Attorneys for Hobbs, who has been Arizona's secretary of state for four years, joined the county in its filing Monday seeking $25,050 from Lake, which includes attorney fees for Hobbs and the state’s most populous county. The county took aim at Lake’s remarks before the election indicating she would not accept the results unless she won, as well as her “groundless” and “frivolous” lawsuit after the election was certified.

“Before a single vote was counted in the 2022 general election, Kari Lake publicly stated that she would accept the results of the gubernatorial election only if she were the winning candidate,” the county said in the filing.

“But she has not simply failed to publicly acknowledge the election results. Instead, she filed a groundless, seventy-page election contest lawsuit against the Governor-Elect, the Secretary of State, and Maricopa County and several of its elected officials and employees (but no other county or its employees), thereby dragging them and this Court into this frivolous pursuit.”

The county added that the courts “should not be used to harass political opponents and sow completely unfounded doubts about the integrity of elections.”

“Enough really is enough,” the county said. “It is past time to end unfounded attacks on elections and unwarranted accusations against elections officials. This matter was brought without any legitimate justification, let alone a substantial one.”

Arizona judge orders Kari Lake to compensate Katie Hobbs for some fees for election lawsuit, but declines to sanction her

A Maricopa County judge on Tuesday ordered Arizona Republican Kari Lake to compensate Democratic Gov.-elect Katie Hobbs for some legal fees related to the election lawsuit Lake had brought challenging her loss, but he stopped short of sanctioning Lake for filing the lawsuit.

Judge Peter Thompson had rejected Lake’s lawsuit on Saturday, concluding that there wasn’t clear or convincing evidence of misconduct and affirming Hobbs’ victory. That Christmas Eve ruling was a major defeat for Lake, who lost to Hobbs by about 17,000 votes in November and sued in an effort to overturn the election.

Attorneys for Hobbs – the current secretary of state – had charged that Lake and her lawyers knew their challenges to the election could not be substantiated, which would violate legal ethic rules. They wanted sanctions against Lake and her team. Thompson did not agree. “The Court finds that Plaintiff’s claims presented in this litigation were not groundless and brought in bad faith,” he wrote on Tuesday.

But he ordered Lake to pay Hobbs $33,040.50 in compensation for expert witness fees and again reaffirmed the election of Hobbs, who will be sworn in on January 5.
