In NY State, if somebody doesn’t technically “rape” someone (i.e., force someone to submit to penile sexual intercourse), one could, instead, be charged with “criminal sex act,” which provides the same penalties as “rape,” if someone, say forces a plunger up an anus or vagina.

I'm simply assuming it was anatomically possible at the time of the crime. Just because a person identifies as transgendered not not automatically mean a person has been surgically altered.

Regardless, I take issue with the person's statement. "good", "loving", "caring" people do not rape and murder.

Kind, people who are kind do not rape or murder.

Once they rape or murder they are no longer good , loving or caring.Maybe they once were.

Alright let's quit with this, 'is it even possible for a woman to rape' crap. If a woman forces sexual acts on someone who doesn't want it then that is still rape or at least sexual assault to the same level as rape, (if one defines rape specifically as forcing penetration on someone). But I think for general speak forcing sexual activities on someone who doesn't want it is rape regardless of the gender of the perpetrator.

Other than that I don't agree with this person getting the death penalty, not because they are trans but because I just don't agree with the death penalty.

Trans folks deserve the honor just as much as do the rest of us.

But I understand that we live in a culture that wants to twist the truth:

Gender Gaslighting. If you call it what it is you are bullied and ridiculed. If you call it what it isn't you are applauded and approved.

I don't have a problem referring to an alter as a different gender because there is an unconscious drive there that is out of touch with reality. But I prefer to refer to an overall person's gender according to their birthday suit with the associated pronouns.

Pre-op TRANS women do have a penis.
