Kaplan had previously ruled that taped remarks Trump made in an “Access Hollywood” tape could be used in a defamation case Carroll brought against him before she filed a rape claim against him in November, when a temporary law took effect allowing adult rape victims to sue their abusers, even if attacks happened decades ago.

He also ruled that two women who made sexual abuse claims in circumstances similar to those alleged by Carroll could testify at trial.

With all the other Trump legal problems this one was unfortunately mostly forgotten about by the media.

After years of back and forth over Trump's DNA, jurors won't even hear about it

The judge presiding over E. Jean Carroll's rape and defamation lawsuit against former President Donald Trump has banned lawyers from even mentioning DNA evidence in front of the jury when the case goes to trial next month.

US District Judge Lewis A. Kaplan ruled Monday that both sides would be "precluded from any testimony, argument, commentary or reference concerning DNA evidence" during the trial, which is scheduled to begin April 25.

Kaplan's order brings to an end a yearslong fight between Trump and his rape accuser over DNA on the dress she says she was wearing when she alleges Trump assaulted her in a Bergdorf Goodman dressing room in the mid-1990s.
Carroll's lawyers had the dress sent out for forensic testing when she sued Trump in 2019, and unidentified male skin fragments were found. Carroll's lawyers asked Trump to submit a DNA sample to test against the samples found on the dress, but for years, he refused.

When Trump brought Joe Tacopina onto the case earlier this year, the new attorney made a last-minute offer to submit Trump's DNA sample. But the discovery period to exchange evidence had already passed, and Kaplan denied the offer, writing that Trump made "no persuasive reason" for not submitting his DNA in a timely manner and that he "failed to demonstrate good cause to reopen discovery."

While DNA evidence was thrown out of the case, Trump's lawyers continued to fight for the chance to question Carroll about her comments insinuating she had DNA evidence to prove her sexual-assault claim.

In his ruling Monday, Kaplan refuted that Carroll's statement was false since the dress was never tested, and Trump's DNA could very well be on it. He also said bringing up DNA at trial would be "distracting and needlessly confusing for the jury, and ultimately would not contribute materially to a fair result in this case."

Trump attorney leaves door open to former president testifying in civil rape trial

Tacopina asked Manhattan federal court Judge Lewis Kaplan to tell jurors: "While no litigant is required to appear at a civil trial, the absence of the defendant in this matter, by design, avoids the logistical burdens that his presence, as the former president, would cause the courthouse and New York City. Accordingly, his presence is excused unless and until he is called by either party to testify.”

Tacopina declined comment on the letter, telling NBC News he's busy preparing for trial.

Trump is on the defense witness list in the case, but previously sat for a videotaped deposition over Carroll's claims that he raped her in a Manhattan department store in the 1990s and then defamed her by accusing her of making the story up for personal profit.

Trump was not included on Carroll's witness list, but language in a February court filing appears to allow her the possibility of calling witnesses from Trump's list.

In a letter to the judge later Wednesday, Carroll's lawyer signaled they were not planning to call Trump as a witness, and that his taped deposition should suffice.

Roberta Kaplan said her client “has a right to play Donald Trump’s deposition at trial” and that there's “no need for him to testify live.”

The letters from Tacopina and Kaplan came after the judge asked both sides whether their clients were planning on attending the trial, which is scheduled to begin Tuesday.

In his letter, Tacopina recounted his experience with Trump earlier this month in Manhattan criminal court, where Trump pleaded not guilty to 34 counts of falsifying business records.

Tacopina said Trump "was always accompanied by approximately a dozen Secret Service agents," a major highway was briefly shut down, and the courthouse "was frozen while he was present" while traffic was shut down for a three block radius.

Kaplan, in her letter, said "the notion that Mr. Trump would not appear as some sort of favor to the City of New York—and that the jury should be instructed as much—'taxes the credulity of the credulous.'”

"Mr. Trump has no right to a judicial endorsement of his (flimsy) excuse," Kaplan wrote, adding that her client "has made clear that she will attend the entire trial and will testify under oath before a jury of her peers

There's some curious connections between Trump and one of Jeffrey Epstein's victims. Virginia Guiffre worked for Trump as a teen in his Mar e Largo resort before she was "acquired" and groomed by Epstein.

Remember, he literally praised Epstein's taste in women and knew he had a thing for teens.

Judge refuses to tell jury in Trump civil rape trial that former president is 'excused'

The response from U.S. District Judge Lewis Kaplan in Manhattan, who is presiding over the trial stemming from writer E. Jean Carroll’s lawsuit, came a day after Trump’s lawyer sent the judge a letter indicating the former president might take the witness stand in the trial, but it would be too difficult for him to attend the entire trial for logistical reasons tied to his former office.

In his letter to Kaplan on Wednesday, the lawyer, Joe Tacopina, requested the judge to instruct jurors: “While no litigant is required to appear at a civil trial, the absence of the defendant in this matter, by design, avoids the logistical burdens that his presence, as the former president, would cause the courthouse and New York City. Accordingly, his presence is excused unless and until he is called by either party to testify.”

Kaplan responded that the court does not accept Trump’s counsel’s “claims concerning alleged burdens on the courthouse or the City” if Trump were to testify at trial. The judge noted that Trump is under no legal obligation to be present or testify, and that Carroll’s counsel has signaled that they were not planning to call Trump as a witness.

Kaplan also cited Trump’s upcoming travel to a campaign event in New Hampshire on the third day of the scheduled trial, while pointing out that Trump is entitled by law as a former president to have Secret Service protection, and that additional security measures can be provided as well.

“If the Secret Service can protect him at that event, certainly the Secret Service, the Marshals Service, and the City of New York can see to his security in this very secure federal courthouse,” Kaplan wrote.

Kaplan also noted that Trump was notified of the April 25 start date of the trial since on or about Feb. 7, giving the former president “quite ample time within which to make whatever logistical arrangements should be made for his attendance.” The judge said that it’s “quite a bit more time” than he was given ahead of his recent historic indictment by a Manhattan grand jury in a case involving hush money payments made during his 2016 presidential campaign.

Fiery opening statements mark beginning of E. Jean Carroll battery and defamation trial against Trump

E. Jean Carroll and two other women will testify in the battery and defamation trial against former President Donald Trump to show Trump’s pattern of alleged violent behavior, Carroll’s attorney told jurors during opening statements on Tuesday.

“Three women, one clear pattern,” attorney Shawn Crowley said. “Start with a friendly encounter in a semi-public place. All of a sudden pounce, kiss, grab, grope. Don’t wait. When you are a star, you can do anything you want. And when they speak up about what happened, attack. Humiliate them. Call them liars. Call them too ugly to assault.”

Carroll is expected to testify Wednesday, according to a source familiar with the matter. The first witness is expected to be Cheryl Beal, who worked at Bergdorf Goodman, the source said.

“You, of course, are going to hear from Ms. Carroll herself,” Crowley said. “She will testify about her traumatic encounter with Donald Trump, about her decision to stay silent so long, and about how when she finally did speak publicly, Donald Trump responded with vicious lies meant to destroy her.”

Carroll will candidly acknowledge the shame she felt about the alleged assault and her decision not to come forward sooner. “How could she tell the world that she had been dumb enough to go into a dressing room with Donald Trump,” Carroll thought to herself, according to her attorney.

At the time Carroll didn’t view Trump as dangerous, but a “character” and “a man about town,” Crowley said.

Jurors won’t have to base their decision solely on Carroll’s testimony, the attorney said, because two friends to Carroll will corroborate her account and two former Bergdorf Goodman employees who worked at the store in 1996 will corroborate details of Carroll’s account. They’ll testify that they personally saw Trump shop at Bergdorf Goodman several times during that time period, a fact Trump has previously contested.

Trump’s attorney Joe Tacopina said during his opening statement Carroll conspired against the former president with the two women, Jessica Leeds and Natasha Stoynoff, because they hate him politically.

“They schemed to hurt Donald Trump politically,” Trump’s attorney said trial evidence will show.

Tacopina told the jury they’re not there to consider the accounts of those two women.

“That’s not for you to decide here,” Tacopina said. “Those people have never made a claim. No one has ever told the police, including Ms. Carroll. No one. Because that would require a real investigation. No one has ever done that. But they want you to focus on anything but the E. Jean Carroll story because it is so incredible and so unbelievable.”

Tacopina asked the jury to focus on the matter at hand and called Carroll’s account vague and inconsistent.

“It all comes down to do you believe the unbelievable. Nothing else in this courtroom matters,” he said.

Access Hollywood’ tape to be played
The jury will see the “Access Hollywood” tape that captured Trump graphically describing how he would use his stardom to aggressively come on to women, Carroll’s attorney said.

“You’ll hear him bragging about doing almost the same thing he did to Ms. Carroll to other women,” Carroll’s attorney said.

Trump has previously said his language on the tape was “locker room talk” not based in truth.

“This is not locker room talk, it’s exactly what he did to Ms. Carroll and other women,” Crowley said in court Tuesday.

Trump’s attorney acknowledged the Access Hollywood tape was foolish but not an admission.

“It’s foolish, but it is locker room talk,” Tacopina said.

It’s OK to hate Trump, his attorney says
On Tuesday, Tacopina walked through Carroll’s alleged account line by line, questioning the plausibility of some details and mocking it at times.

Carroll “did not produce any objective evidence to back up her claim because it didn’t happen,” the attorney said. Carroll, a columnist known to keep a diary, did not document the account in her personal diary, Tacopina added.

“She is abusing the system by advancing a false claim of rape for money, for political reasons and for status and in doing so she’s really minimizing the true rape victims,” Tacopina said. “She’s exploiting their pain and their suffering.”

He told the jurors that they can feel free to hate Trump.

“People have very strong feelings about Donald Trump,” Tacopina said. “You can hate Donald Trump, it’s okay. There’s a time and a secret place for that. It’s called a ballot box. But not here in the court of law.”

Will Trump testify?
Trump’s legal team will not put on a lengthy case in his defense, Tacopina suggested, but will seek to knock down Carroll’s case during cross examination of plaintiff witnesses.

“It’s coming out through the questioning of their witnesses. That’s our entire defense. That and some sworn testimony from Donald Trump that you’re going to see,” Tacopina said. “There are no witnesses to call to prove a negative.”

Trump is unlikely to testify in his own defense, but will rely on previous denials including in a video deposition taken last October in this case, Tacopina also suggested.

“There’s absolutely nothing more for him to add,” the lawyer said. “I don’t want to distract from the focus of her story.”

After the jury was dismissed for the day Judge Lewis Kaplan challenged Tacopina to confirm that Trump would not testify in his own defense.

Tacopina said he still doesn’t know definitively whether Trump will testify.

The judge told Trump’s counsel that it’s an imposition on court staff and security to leave the question unanswered and so Tacopina must inform the court definitively at some point this week

E. Jean Carroll says in court, "I'm here because Donald Trump raped me"

Beall also said that changing room doors were often unattended, with the doors propped open.

n opening statements, Shawn Crowley, an attorney for Carroll, said Monday that Trump and Carroll had bumped into each other at the department store, at first engaging in friendly banter as they walked through the store.

"Hey, you're that advice lady," Trump allegedly said, according to Crowley. She said Carroll responded, "Hey, you're that real estate tycoon."

At some point, the two allegedly entered a dressing room, and Crowley said Trump "suddenly" pushed Carroll against a changing room wall, raped her, and then tried to ruin her reputation after she told the story in 2019.

Trump 'raped me': E. Jean Carroll testifies about alleged attack at trial

Writer E. Jean Carroll took the witness stand for her lawsuit against former President Donald Trump on Wednesday, telling jurors: "I’m here because Trump raped me."

When she stepped forward with her allegations in 2019, Trump "lied and shattered my reputation, and I’m trying to get my life back," Carroll said during her testimony at the civil trial in federal court in Lower Manhattan.

Carroll, 79, said she first met Trump — who has said he doesn't know who she is and had never met her — in 1987 at a "Saturday Night Live" party, where she was a writer at the time. She said she believes that's where a picture was taken of her with Trump, his then-wife Ivana and Carroll's husband at the time who was a popular local news anchor.

Carroll, who previously wrote an advice column for Elle magazine, said the next time she spoke to Trump was when she ran into him at the Bergdorf Goodman department store near Trump Tower in 1995 or 1996.

"He said, 'You're that advice lady,' and I said, 'You're that real estate tycoon,'" she told the jury. "He was very personable."

Carroll said Trump, who at that time was married to model Marla Maples, told her he was there to buy a present for someone, and asked if she'd help him. They first went to handbags and then hats before Trump suggested they go to the lingerie section on the sixth floor, she said.

"He was very talkative on the escalator and said he was thinking of buying Bergdorf," Carroll said. "I was thinking, 'I have a great story,' and I was delighted to go to lingerie" with him. She said they then looked at lingerie together and "he was joshing and pleasant and very funny."

Carroll said they each suggested the other try on lingerie, adding she thought that was funny. She said that she "didn't think anything about what was about to happen" because the door was open when he motioned her toward the dressing room.

Trump then "shut the door and shoved me against the wall," Carroll said. "I pushed him back and he thrust me back against the wall, banging my head."

"He put his shoulder against me and held me against wall," she testified. Carroll broke down in tears as she recalled in her testimony Trump penetrating her.

"I couldn’t see anything was happening, but I could certainly feel that pain," she said.

The attack lasted "very few minutes," she said, and then she rushed out of the store before calling a friend to tell her what had happened.

Carroll said the friend, writer Lisa Birnbach who's expected to testify in the trial, encouraged her to go to the police. She said she responded, "No way."

"I thought it was my fault," she said.

Since the alleged assault, Carroll told the jury on Wednesday, she hasn't had a romantic relationship with anyone and hasn't had sex. She said that she "always believed" what happened with Trump had a "strong influence" on her inability to find romance.

"I found it impossible to believe that I could meet someone, impossible to even fall in love or have dinner and smile," said Carroll, who began crying on the stand.

She said she missed out on "being in love with someone else," which she said is "one of the glorious things" in life. "I am aware of how much I lost and I feel like I should be able to overcome it."

Carroll said she has returned to Bergdorf Goodman since it happened and said it hasn't been triggering to her. She said that she has spoken to a therapist about it, but she said he didn't diagnose her with anything.

Carroll also told the jury that when she was 12 years old, she was "fondled" by the waterfront director at a Girl Scouts camp when he took her out on a boat after she won a contest. "I didn't tell anyone else," she said of the alleged incident.

When Trump announced he would run for president, she said she didn't think he would be a good commander-in-chief "because he was evil, because he raped me" and "his politics were terrible."

Carroll went on to say that after an excerpt of her book was published by New York Magazine, Trump responded with "name-calling [and] threats."

“He knows it happened,” Carroll said, adding that she was surprised by Trump's response to the book excerpt.

Trump has repeatedly denied Carroll's allegations, including in posts on his social media website Truth Social as recently as Wednesday morning.

In two statements on the case shortly before testimony was set to begin, Trump called Carroll's allegations “fraudulent & false” and a “SCAM.”

He also brought up in his posts to Truth Social two topics the judge in the case, U.S. District Judge Lewis Kaplan, had previously told both sides not to bring up in front of the jury — one having to do with DNA evidence and the other having to do with the payment of Carroll’s legal fees.

Trump's DNA evidence comment involved the dress Carroll said she was wearing on the day of the alleged attack, which has a small amount of “genetic material” from an unidentified male. Carroll’s attorneys had asked Trump for a DNA sample to compare it, but never asked for a court order for the sample.

Trump’s attorneys never provided a sample, and the judge ruled in February that neither side could bring the issue up at trial.

In his post Wednesday, Trump wrote, “She said there was a dress, using the ol’ Monica Lewinsky ‘stuff’, then she didn’t want to produce it. The dress should be allowed to be part of the case.”

The judge told Trump lawyer Joe Tacopina that his client had refused to give a DNA sample for three years, “and now he wants it in the case?”

Trump's posts also complained about Carroll getting financial support for her lawsuit from a Democratic donor, something she'd denied when she was initially deposed in the case but later acknowledged. The judge is scheduled to rule this week on whether the jury can be told about the omission, and had instructed both sides not to say anything about it to the jury in the meantime.

"Your client may be tampering with a new source of potential liability. And I think you know what I mean," Kaplan told Tacopina.

Tacopina said he would ask Trump not to post about the case.

I have little doubt that he’s all the vile things many people in his business and private life say he is - including a rapist, multiple times over. Definitely plenty of news stories about that - the 13yo girl he raped with epstein comes to mind -> + multiple other accusations.

It’ll be sweet sweet justice if he goes down for multiple crimes he’s committed, including this alleged one. Also kinda funny to picture him ranting and raving about being sent to a hoax jail for hoax crimes. :P Ok, crazy old man.. take your meds and stfu.
