Yes! That bothered me too! It was a bit of a relief when he finally died for real even though I did like his character before he died the first time.
Arrested Development had some annoyingly glaring inconsistencies, but the whole show was random enough that I was able to continue watching it. The niece's hair would be straight in one scene and then curly in the next scene and then straight again (when it was supposed to be the same day). Looking back, I think I annoyed my husband by mentioning it every single time
