http://thegrio.com/2015/04/12/11-year-o ... -a-felony/

The gist of the article: school made up a "special" rule for the autistic boy that he had to leave the classroom after all the other children left. Boy refused to follow the new rule. Teacher responded by calling the police, who grabbed the boy, yelled at him. Boy has meltdown and kicks trash can (TRASH CAN - no one was hurt) and is now being charged with assault of a police officer - a felony.

I hope this mother sets up a criminal defense fund so I can donate, and I hope she sues all the way up to federal court so this never, never happens in Virginia again.

I'm not sure what I find worse. The fact that the person being charged with a felony is autistic or the fact that its an 11 year old kid!! !! !!

Leaving the autism aside this is just an absurd thing to happen to any 11 year old child. What the hell are the school doing getting law enforcement involved. Sure if the kid pulls a knife or seriously hurts another pupil then call the cops. But kicking a trash can? Please? If I were the cop I'd be too embarrased to arrest the kids and would tempted instead to charge the school administrators with wasting police time / being a total bunch of douche bags.

Some people only seem to know how to set up children to fail. Beyond sad.

Quote:
“He grabbed me and tried to take me to the office,” Kayleb told PRI. “I started pushing him away. He slammed me down, and then he handcuffed me.”
...
According to his mother, the judge “said that Kayleb had been handled with kid gloves. And that he understood that Kayleb had special needs, but that he needed to ‘man up,’ that he needed to behave better.

Unbelievable. Telling a disabled child to "man up?" Something's wrong with the system.
