I was wondering if any one had any input/advice for me...My son will be 3 next month, he was just evaulated by our intermediate unit for services. He qualified only for a itinerant teacher to assist with social skills (our biggest issue). They insist he does not meet the criteria for OT/speech because he does not have a '25%' delay. I can find no mention of this in IDEA 2004. Where is this '25%' coming from? Can I challenge this?

Good question... I think the 25% delay is the state interpretation of the IDEIA. (I think) I know that it is a common way of defining a delay. While IDEIA states "significant delays". The school or the state has to determine how to quantify a delay. 25% is used in every system I know about. I'm not sure if you can challenge this. Does he have any delays, if so how much of a delay?

I find that state-provided services suck and I can do a better job myself at home. I've never heard of the 25% thing, sounds like BS. I'd challenge it.

I'm sure the quality of services varies from place to place. In some districts the services are excellent, in other districts, probably not so much.
