What the hell is the OP going on about? If you intentionally kill another citizen, not in self defense, whether they're military personnel or civilian, that's murder.

Oh come on. Miltaries bomb other military facilities all the time even when its indirect "self-defense". Although I think the problem is that this guy was acting alone. See, you can't really arrest someone if they bomb you from a warplane.

Still an act of treason which is punishable by death.

Well, this guy wasn't from another military, period.

Even further, I don't see how your excuse is reasonable or makes sense. Think about it: are you an enemy combatant if you shoot an officer? No, you're a murderer. It wouldn't matter how many tapes you had saying "dirka dirka jihad", because you are not part of a military action, you're just a guy who shot somebody. In a situation of treason, it also really wouldn't matter whether you were part of a larger military action anyway, because you betrayed your nation.

It wasn't anxiety, a lot of troops have anxiety about going to war. He wasn't even going to be going outside the wire for his duties. His problem was that he was an islamic militant. Plain and simple.

I am glad that you have such a complete grasp of the evidence that you are capable of reaching a legally and medically sound conclusion without the tiresome rigmarole of listening to witnesses. Fortunately the presumption of innocence is in safer hands than yours.

For myself, I prefer to withhold my invective until a Court (or a Court Martial) of competent jurisdiction has had the opportunity to hear evidence and argument from both sides. Once he has been found guilty, then I will join you in expressing my sentiments.

If you catch an enemy disguied in your militaries uniform you can shoot them upon capture. They shot German soldiers who were captured durring the battle of the bulge durring WW2. They were dressed up as US soldiers. They even disguised German tanks to look like American Tanks. The British had some of their comandos shot for wearing German uniforms.
