In some cultures that is the case. I agree with you that they do not need to treated cruelly.
Considering the US and it's post-industrial society, if we gave "Animals" those same rights as you would a human, could you see how that would create a vacuum in the legal system? I would go to "dog-court" and go to "dog-trial" for abusing my dog.

I testified as a character witness for a dog in a hearing at the county animal shelter in which the dog's human owners hired a lawyer. It was a criminal trial in all but name. So animal trials de facto exist already. So why not just recognize the fact in public?
