The wrong question is being asked, in my view.

There is no question that warterboarding falls within the definition of torture under the United Nations Convention Against Torture, which convention the United States has both signed and ratified.

The proper question is whether the use of waterboarding can be justified by a state who has signed an international convention ot ban its use, and incorporated that convention into its domestic law.
