Actually it is quite legal as long as the business documents a reason for it other than it being due to gender. Several smaller employers that I have had start their job offers at a much lower pay for women, and can get away with it by saying that it was because of current financial concerns (as long as they don't offer higher pay for the exact same job on the exact same day). A business can also use a several month gap in a resume where a woman took time off for maternity by saying that they want someone with continuous experience. There are actually hundreds of technically legal ways for an employer to pay a woman less. The same can be said for homosexuality. In some states, it is 100% legal for any and every employer to discriminate against them when it comes to employment, with many solidly red states actually passing laws making it even easier.
Although there are some individual states that have passed laws making this sort of behavior more difficult to get away with.

The law is both a curse and a blessing. Which is why laws should always be carefully constructed and implemented, with a serious review of their weaknesses and inefficiencies in order to repair them when needed.

So I guess the fix is for a law to be passed where ALL women applicants must be hired and go to the top of the pay scale, regardless of qualification and/or experience.

No one's saying that; rather, it's a matter of women doing the same job as men, with the same capabilities, being able to earn the same amount of money.

What we need is a revision of the law in a way that reduces the number of loopholes available for employers to play dirty games with demographics they don't approve of. Women aren't the only ones, just the most statistically obvious.
