That's not the rule. The rule is no hiring of prostitutes, even if the local laws allow for it. Germany and Australia both have legal prostitution, but American personnel stationed there can be charged with a crime under the UCMJ if they hire one of these prostitutes. Adultery is also against the UCMJ. Unmarried sex is not, so long as the first two rules are not violated.
