An idea to make justice more fair
So, my sister told me recently about an idea to make justice more fair.
With this new idea, the defendant's name would be hidden to everyone except the judge, and he or she wouldn't be visible to anybody in the courtroom (instead in a separate room), but allowed to watch his or her trial on video. For the questioning, he or she would sit at a computer and type answers in real time as the prosecutor/defense attorney asked questions, like a chat room. These answers would be shown to the courtroom. The idea behind this is that if no one sees the defendant, and the jury doesn't know his/her name, there would be no more convictions/acquittals due to race.
No.
It would be unconstitutional and open to abuse.
The 6th Amendment to the U.S. Constitution sets out the right of the accused to confront their accusers. The relevant text of the Confrontation Clause of the 6th Amendment reads as follows: In all criminal prosecutions, the accused shall enjoy the right to be confronted with the witnesses against him.
The confrontation clause guarantees criminal defendants the opportunity to face the prosecution's witnesses in person in the case against them and dispute the witnesses' testimony in person.
Besides, what's to stop an unscrupulous prosecutor from hacking the system and replacing the defendant's own typed testimony with a contrived and utterly false "confession"? One moment the defendant is typing in how he came upon the crime scene after the police arrived, and the next moment he's being body-slammed against the floor by a half-dozen SWAT-cops because the judge and jury received the statement, "I want to change my plea to 'Guilty' because I killed them all before the cops showed up."
No, this is definitely NOT A GOOD IDEA!! !
