JOINT RESOLUTION
Proposing an amendment to the Constitution of the United States to prohibit change of the sex designation of non-intersex persons and to prohibit funding or requirement of funding for sex transformation for the same persons.
Resolved by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each House concurring therein), That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by conventions in three-fourths of the several States, as provided in the Constitution, within seven years after the date of its submission for ratification:
``Article--
``Section 1. A person who is born with external genitalia that is unambiguously male or female shall therefrom be recorded as respectively male or female, regardless of any sex transformation undergone during the course of the same person's life; the same person shall not be considered intersex for any purpose. Intersex persons shall have their sexes recorded as legally and medically appropriate.
``Section 2. For purposes of placement in prisons, schools, hospitals, bathrooms, and all other areas segregated by sex for the purposes of privacy, each person shall be considered of the recorded sex as specified in the first section of this article and placed accordingly.
``Section 3. No public funds shall be appropriated for sex transformation of non-intersex persons, neither shall law or regulation require for the same the provision of funds by corporations or private businesses or persons, except insofar as to enforce legal contracts between non-governmental parties.
``Section 4. The Congress shall have power to enforce this article by appropriate legislation."
