Rep. Peter King (R-L.I.) rose to propose an amendment directed at a dangerous new threat to national security.

His motion was a response to the "John Doe" lawsuit filed by six "Flying Imams." Last November, the six were ejected from a US Airways flight after their fellow passengers reported what they saw as strange and disturbing behavior. The imams claim that they were victims of "intentional" and "malicious" discrimination and are seeking compensation, including punitive damages - from the airlines, and also from the passengers and crew, who are identified in the suit as "John Does" to be served with legal papers once a court order reveals their actual identities...

King explained as much, speaking on behalf of his amendment, which would protect anyone who makes a reasonable, good-faith report of suspicious activity from being the target of a lawsuit. "We have an enemy which is constantly adapting," King said Wednesday. "We have to think outside the box."...

Every New York City rail and transit rider has seen the signs: "If you see something, say something." The principle is obvious - in an age of terror, we should all have our eyes open. If the imams' lawsuit prospers, how many people won't say something - for fear of being sued?...

Rep. Bennie Thompson (D-Miss.), the chairman of the Homeland Security Committee, took the floor to oppose King's motion - and to defend the lawsuit against John Does. "We should be tolerant," he argued; people shouldn't be singled out because they "look different."

In fact, the flying imams triggered concerns by a variety of unusual actions, as well as words that roused the concern of another Arabic-speaking passenger. Witnesses say that House members started booing Thompson.

Finally, a member of the leadership realized how this would look to Americans watching on C-SPAN: Rep. Rahm Emanuel (D-Ill.) was seen staring at Thompson and repeatedly drawing his hand across his throat - an urgent signal to get off the floor.

With Democrats realizing they couldn't argue against King's measure, it went to a vote, and passed, 304 to 121

Every one of those 121 votes aimed at defeating protection for "John Does" was a Democrat - indeed, more than half of all Democrats present voted "nay."

And, with the exception of Rep. Anthony Weiner (Brooklyn), Democrats from the New York-New Jersey metro area led the way in voting against it.

Rep. Jerrold Nadler, whose district includes Ground Zero, voted no. So did Rep. Carolyn Maloney, whose district includes Midtown, and Rep. Nita Lowey, who lost dozens of Westchester neighbors on 9/11.

Rep. Bill Pascrelle hails from New Jersey, the home of 700 9/11 victims. Earlier that night, he had praised the bill's provision protecting government whistleblowers from retaliation. But he voted against such protection for John Does who don't have government jobs...

Nihad Awad, CAIR's executive director, defends the suit's targeting of ordinary citizens. The clerics, he explains, will only sue passengers who made false reports or acted in bad faith. But the suit cites an "elderly couple" who watched the imams in the gate area and then made a cellphone call. How will CAIR determine who the couple called and whether anything they did was intended to discriminate against the imams, without first finding out their names and forcing them to defend against the charge? What about their civil rights?

In the future, who will be willing to risk their savings in the face a potential lawsuit underwritten by wealthy Middle Eastern donors?

If King's measure becomes law, that worry will vanish. But the bill will have to survive the instinct of Congress' Democratic leadership to pander to political correctness and CAIR's special-interest pressure.

you sure you're not just posting spin?

i agree with some protection for john does....but at the same time, just because some redneck has never seen a brown person before doesn't mean that they should be protected for calling the feds on them.


i'm not familiar with the flying imams incident.....got any link to an actual story for that?

I found this, admittedly this is another op-ed by Mrs. Burlingame. I will look for something news story tomorrow, although I know these facts fit what happened:

After boarding, they did not take their assigned seats but dispersed to seats in the first row of first class, in the midcabin exit rows and in the rear--the exact configuration of the 9/11 execution teams. The head of the group, seated closest to the cockpit, and two others asked for a seatbelt extension, kept on board for obese people. A heavy metal buckle at the end of a long strap, it can easily be used as a lethal weapon. The three men rolled them up and placed them on the floor under their seats. And lest this entire incident be written off as simple cultural ignorance, a frightened Arabic-speaking passenger pulled aside a crew member and translated the imams' suspicious conversations, which included angry denunciations of Americans, furious grumblings about U.S. foreign policy, Osama Bin Laden and "killing Saddam."

Predictably, these imams and their attorneys now suggest that another passenger who penned a frantic note of warning and slipped it to a flight attendant was somehow a hysterical Islamophobe. Let us remember that but for their performance at the gate this passenger might never have noticed these men or their behavior on board, much less have the slightest clue as to their religion or political passions. Of course, that was the point of the shouting. According to the police report, yet another alarmed passenger who frequently travels to the Middle East described a conversation with one of the imams. The 31-year-old Egyptian expressed fundamentalist Muslim views, and stated the he would go to whatever measures necessary to obey all the tenets set out in the Koran.

I found this via Captain's Quarters Blog. There also have a quotation from an old Washington Times article (I usually don't like to use them, but this seems fair enough):

The Department of Homeland Security's (DHS) Office of Civil Rights and Civil Liberties is reviewing the actions of department members who were involved in the incident. Secret Service agents questioned the imams, who are accused of making negative comments about President Bush and the Iraq war. Officials of the Transportation Security Administration were involved in screening the imams and their baggage. "There is no indication there is any inappropriate activity, at least no indication at this time," DHS spokesman Russ Knocke said. "To my knowledge, we are only doing a review, and that is a fairly routine practice with incidents like this." The Air Carrier Security Committee of the Air Line Pilots Association investigated the incident and said, "The crew's actions were strictly in compliance with procedures and demonstrated overall good judgment in the care and concern for their passengers, fellow crew members, and the company."

When an airplane is in midair, one (usually, occasionally an air marshal is present) could not call "the feds" to simply haul off someone behaving suspiciously.

the initial article doesn't talk about mid-air. it says the passengers were ejected....and if they were ejected mid-air...i could understand why they'd want to sue!

The point was that without, they probably wouldn't be ABLE to sue.

well most of the right and the left are just monkeys....so i think feces throwing is pretty natural to them.
