So it'd be legal to play Gillette's "Short Dick Man" on the radio, but not the "clean" "Short, Short Man"? Then again, the former could also be interpreted as an attack on a short detective.

I think that you meant it the other way around.

"Short Dick Man" is obviously not about stature whereas "Short Short Man" could be taken on its face to be about being vertically impaired (rather than horizontally impaired).

Local police departments dont hire people under some height limit. So wouldnt that create problems?

I think that's a smart move on the part of New York City. I hope that other cities around the world follow their lead.

Actually, employers get around anti-discrimination laws very easily. All that they have to do is say that the reason for a decision was not related to a person's protected class, however flimsy the reason. The burden of proof falls on the person discriminated against. Very difficult to do.
