Child porn cartoon conviction upheld in Va.

Among the arguments in his appeal was that cartoons are protected under the First Amendment because they do not depict real children. He also claimed the statute is unconstitutional because text-only e-mails cannot be obscene.

Two judges rejected those arguments. A third agreed with Whorley on those issues but joined the majority in affirming his convictions on the counts pertaining to photographs.

Judge Paul V. Niemeyer noted in the majority opinion that the statute under which Whorley was convicted, the PROTECT Act of 2003, clearly states that "it is not a required element of any offense under this section that the minor depicted actually exists."

Rob Wagner, the federal public defender who represented Whorley, said he was "very disappointed" with the ruling and that he would ask the full appeals court to reconsider. If that fails, Wagner said he will petition the U.S. Supreme Court to review the case.

A Virginia jury convicted Whorley of 74 counts including receiving obscene materials, receiving obscene visual representations of the sexual abuse of children, receiving child pornography and sending and receiving obscene e-mails describing the sexual abuse of children.

Whorley, 55, is serving his sentence at the Gilmer Federal Correction Institution in Glenville, W.Va.

He previously was sentenced to 46 months in prison for a 1999 child pornography conviction.


This sort of thing scares the hell out of me. Despite not being a consumer of child porn, drawn or otherwise, the idea that putting a pen to paper can result in a sex crime charge horrifies me. What is the state's interest in this sort of thing if no actual children are involved, other than to enforce a standard of sexual morality?

It's seldom someone gets locked up for lolicon, but if some ass wants something easy to convict someone of, it works. Then again, anyone could easily go to http://flatchaan.org or http://12chane.org/ with no problem.

Bingo. Marriage (as a legal institution, not a spiritual commitment ceremony) and family (divorce) law are basically the same thing. That's why we have the Defense of Marriage Act (DOMA).

I thought child porn was illegal, because the children are abused.... If it's drawn, there's no abuse going on.... I don't see the problem here...

While I am very much against child porn, it should definately NOT be illegal to own some CARTOONS.....

in my opinion, no victim= NO CRIME POSSIBLE, although a great majority of our laws persecute people who did nothing of harm to anybody.

Like gay couples.

The real test is whether or not he'd be convicted just for the anime. This version of the story says he was also in this case receiving real child porn, which is rightly illegal. The Comic Book Legal Defense Fund, here http://www.cbldf.org/ denies that there were any actual photos of minors involved, so I'm not sure which story is more accurate.

Quite apart from the characters not being real, there's the issue of how exactly you tell anyone's age, if it's not explicitly stated, in an art form that depicts people in a stylized manner as anime does. Same could apply to many other cartooning styles.

You've really gotta be careful with pornography, especially if it's the kind circulated by pedophiles for their private & extremely vile enjoyment. Even if it doesn't involve photography of actual nude erotically posed children, it's still grist for the pedophile mill. It's what gets these guys all hot and bothered and wanting to f**k a real live kid. So that's why I say no to kiddie porn of all varieties. Animated or otherwise.

i'd rather allow them an animated output rather than being all hot and bothered with no output and potentially more impetus to either photograph real kids or harm real kids. i think the denial of some kind of sexual output for those people would cause more trouble. but then again, i'm thinking of it as a pacifier, not cannon fodder.
