That's not the core of Ezra's argument. What he was arguing was that the citation and the neighbor's action in reporting her to police were justified:

You're missing the point - he said that if the neighbour thought they were reporting something illegal, the call was justified, which is correct. I still think they could have channelled their sudden attack of "civic duty" in better ways, but I can't blame the neighbour for not knowing the law since apparently even the police doesn't.

He didn't derail - he asked for proof that "death threats" were made against the woman, which nobody could provide.

I like the 'it was done on private property' argument, as if doing something outside in plain view, is the same as doing something within the privacy of ones own home.

That's generally an interesting question: where are the boundaries of public view?
What if you were having sex in your garden behind an opaque fence? A shrubbery? A fence with everything visible? In a greenhouse? In your living room with big, street-facing windows with lights on?

I happen to have a huge window in the bathroom - should I be arrested if I use the toilet and forget to cover the window?

Joking aside, it would be interesting if someone with actual legal knowledge would chip in - can a legal activity become illegal if it's visible?

I saw a COPS episode where a man was arrested for standing in front of his window while masturbating. Took place in an apartment complex. He had a second story apartment with a window facing the driveway.

I am experiencing hot flashes. I go out on my back porch in just a bra, to cool off when I'm getting ready. We have a privacy fence, but our neighbor behind us has a two story. Not that I'm a spring chicken, but the last thing I need is the cops called on me for indecent exposure. I'd never explain that one and I'd never go back to work.
