It is not illegal to burn the Australian flag. Two bills in 2003 and 2008 seeking to outlaw the practice failed to pass the senate.

Whether or not it is, I think the habitual offender status was the main factor in the sentence. Even then, 15 years is a lot for destroying property.

It's 50/50 as to whether the habitual offender or the hate crime aspect factored in most in this most harsh sentence.

The CNN article and my post used both the phrase "faces" and "was sentenced to".
Thats what the CNN article said,the writer made the article confusing in that way by using both terms.

All my data sources are giving mixed messages, too. In any case, the perp is a repeat offender and a religious nutter who claims that it is an honor to be guilty of his crimes (e.g., arson in the 3rd degree in violation of individual rights, harassment in the 3rd degree, and reckless use of fire or explosives). No wonder the prosecuting attorney believes him to be dangerous and recommended the maximum sentence. I would, too.

Look at the case in its entirety, and any reasonable person would reach the same conclusion.

I have the article on my phone right now.It says:A man has been sentenced to 15 years in prison for burning a LGBTQ flag.

Then it later says:The 30 year old faces about 15 years after being found guilty of arson in the 3rd degree,violation of individual rights,harassment in the third degree and reckless use of fire or explosives.

The article contricts in it's language of "faces" verses "has been sentenced"

But the point is I wouldn't call burning a flag arson,arson is more burning a building or a structure,to burn a flag in protest is an American right,so long as you don't tresspass and steal a flag,which is what this guy did.

But the article contradicted itself not me.I don't have a link but CNN has the article or google it.

I hate ambiguous journalism, and long for a return the day day of honest and accurate reporting. I guess that's too much to ask from CNN.

If you can access the article then you have the link. The procedure is simple. Try it sometime.
