The nature of death penalty appeals-----is the "grasping for straws."

It's obvious to most and sundry that the defense team and Roof's family are "grasping for straws." Any appeals judge worth his/her salt will know this implicitly.

Apparently, like the Unabomber, Roof would rather die than get off on an insanity plea. But like Kozinski, his lawyers are trying to wrangle an insanity plea for him anyway.

But even if he really were proven to be autistic what does that have to do with his guilt (or lack thereof)?

Autism doesn't interfere with your ability to tell right from wrong.

Having delusions might interfere with your ability to tell right from wrong. But delusions are a symptom of psychosis, and not of autism.

If this becomes a precedent...killers avoiding capital punishment due to autism...that will be a disaster for the autistic community. Autistics should picket and demand the death penalty for him.

What does that have to do not knowing right from wrong?

You could just as easily argue that "because autism causes obsessions, and black and white thinking, autistics are more likely than NTs to be obsessed with imitating Mother Theresa, and to do charity for the wretched and the poor, therefore autistics should be held to a higher moral standard than NTs and should serve longer prison sentences than NTs for the same crimes (like officers are shot for cowardice when they don't shoot privates)." :lol:

In the article he is quoted as saying "I am JUST a sociopath. Im not an autistic. That's for nerds".

We cant have nerds/aspies going around thinking that they are as good as....sociopaths...now can we!?

During those acute reactions I've never thought about killing someone .

If only "White Supremacy" would be labelled and legislated as a form of insanity. Imagine how many people would have their firearms confiscated, and how many more would be forcibly medicated...

It's gonna be a tough go for DL's lawyers, since DL was found guilty of all charges and sentenced to death in federal court, and pleaded guilty and received nine life sentences to all counts in state court.

The lawyers would have to prove that the guilty plea was made under duress.

Well actually it IS about knowing "right from wrong" if you're talking about the "insanity defense".

But lets go with your notion.


So lets say that something akin to the insanity defense can also be about "uncontrollable behavior".

I am on the autism spectrum but I don't have an uncontrollable urge to mow down people in churches.

This is not about an "insanity defense".

This is regarding whether autism played a casual role, and he should be spared the death penalty.

It seems like the arguments presented here suggest, AUTISM CAN NEVER CAUSE CRIMINAL BEHAVIOR?

If autism played a "casual" role, then the sentence should stand.

If it can be proven that autism played a major "causal" role, then maybe I might advocate for a commutation to a life sentence. But I don't sense this is the case in this instance. I sense his racial prejudice had nothing to do with autism. Autism does not cause racial prejudice.

I can see how autism could contribute to some minor misdemeanour like jaywalking or forgetting to pay for something but I don't think you'll find many people who would agree that autism can cause someone to commit premeditated mass-murder.
