Not really. The age of consent is 16 in the UK but it is often not enforced as long as it's not an abusive relationship or the guy isn't older.

Really, it depends on how much she understood what was going on aside from the age of consent issue.

I'm not talking about legal consent. I am talking about actual consent. Did she fully understand and decide that she wanted to do it.

Legal consent is a completely different matter.

Here in Alabama, when I was a young teenager, you could get married at 14 with your parents permission, yet the age of legal consent for sex was 16. Legal consent is nothing more than an arbitrary guidline of when we as a society think that someone is old enough to have sex. Legal consent is only used to prosecute statuatory rape. Now in some cases it truly is taking advantage of someone, but in many cases it isn't. A for instance is that a member of my extended family was 18 and the girl he was dating was 15. They dated a while and had sex on a regular basis for a few months. He broke up with her, I don't know over what, and she got mad, knew about the statuatory rape laws, told her daddy and he went to the cops and they arrested that boy and charged and convicted him with statuatory rape. Of course none of the other boys she had slept with were arrested and convicted because she didn't tell her daddy about them. Yet this kid is a sex offender for life. His offense against her on paper and legally is having sex with her when she was under the age of consent, but his offense against her in reality was breaking up with her and that is what she was upset about, not the sex. See my point with the legal consent age?

But the point of my post was that a 15 yo many, many times has the mental ability to consent. Some don't, NT and AS, but many do whether NT or AS. What bothers me is if a 15 yo NT girl were to have sex with an 18 yo boy nobody would assume that coersion was involved. If a 15 yo AS girl did, everybody would assume that he talked her into it, used her for sex, and that [b]she really didn't understand what sex was and what he wanted.[b] Because she has AS? Gimme a break. Some with AS wouldn't, but there are plenty who would. I get ticked when people automatically assume that anyone with AS is incompetent in an area simply because they have AS. It's not automatic.

No, what I'm trying to say is that if she's 15, the guy who had sex with her is breaking the law on that. Whether he can be done for rape is, as you say, down to whether she consented or not. If she consented, then it's really arbitrary.

I understand perfectly what you're saying, though. A lot of times, age of consent laws are really just extra risk for the guy.

Wow, I had no idea teens could take advantage of the law, I knew parents did but not teens. Yep another reason for people to not have sex with someone under the age of consent.

I've got an even better idea: Why didn't the guy just think with his big head instead of his little one?

Or maybe people shouldn't be calling someone who had sex with a girl who'd be legal in many countries a pedophile. It's quite stupid really. The law where he happens to live is just not in his favour, he's not an actual pedophile. A pedophile is someone who has sex with a child who literally cannot understand and consent to it. That's far from the case with a 15 year old. Surely you get the difference?

BTW, I also read a similar article where this happened with a female teacher and student, so it's not just men, Longshanks.

same in denmark.

i find it very disturbing that things like this can happen… i mean… if i met a 15 yo aspie girl in denmark and we had consensual sex, it would be perfectly legal.

not so if was to be her guardian, teacher, trainer, stepfather etc.

strange.

thereby not saying that nobody should be concerned for young people getting abused!

This thread is still pertinent. A stepfather slept with his step-daughter.
And she was a minor.
And she is autistic.
3 wrongs, not one.

3 corrections:

- they had (consensual or not) sex… i certainly don't hope that sleeping together is illegal too…
- she was a minor in her particular country…
- having sex with an autistic person is not automatically wrong…

so essentially it boils down to this and the questions to be asked are:

- why is the age of consent so different in different parts of the world?
- why are adolescents in other parts of the world regarded as being more mature at an earlier age than adolescents e.g. in the US?
- why can any random adult legally have consensual sex with any adolescent of age, but not her step-parent/teacher/trainer, etc?
- why can step-parents/teachers/trainers at the same time legally have consensual sex with everybody else (of age!) if they like?

^ The age of consent varies from place to place because the perception of cognition of sex varies from culture to culture. It varies in different governmental areas withing a culture because of the views of those who make the laws.

Your other questions can be answered by this. It's the social norms in particular cultures that consider it taboo. Something may be legal but it can still be taboo. Society sometimes takes over when someone crosses an unwritten line that we consider intolerable. While we (and by we I mean society in general) cannot do anything to this person, we can shun them.

Obviously you didn't read my first response where I did mention that it was a tragedy that women only get a slap on the wrist for this stuff while men get slammed down hard.

I did, that's what I was responding to. This claim is nonsense because I also read of a female who got put in jail for a similar thing.

It would not make any difference, it would still be illegal under US law.

Umm, she called him his daddy?

Clearly the guy is a prick and clearly he took advantage of her, whether people want to admit it or not.

Whether it was consensual or not, I don't know, but the guy is still a prick (I am a male by the way). I know enough about the way men think to know this.

I would not have sex with someone I knew to be 15 years old. I would not allow her to call me "my daddy." I mean come on, it is sickening.

There is a point here where the woman's views need to be taken into consideration, but my intuition tells me he deserved what he got. There is something to this idea of desexualing disabled people (I suppose?) but I just don't buy it in this case. He was in the wrong, he knew he was in the wrong, and he did it anyway.
