theres nothing illegal about answering the door with a firearm

Actually depending on where you live, that could be a violation of all kinds of laws. Regardless doing that, it would be a 100% justification for a cop to shoot you almost anywhere.

The problem here is that he didn't have a firearm.

other than a few states you are allowed to have firearms, the majority of the states in united states have open carry laws. you can answer your door holding a firearm, the police can ask you to put it down but theres nothing illegal about having a gun

I'm pretty sure they don't reject applicants on the low end if the IQ spectrum. Until maybe 15 years ago, I would have agreed with you that most cops had an average or maybe even slightly above average IQ. But the cops today are just dumb.

Most of the cops working today, get out of High School and join the military. They spent their time in Iraq or Afghanistan. Then they come back and get on the police department. They have no education, no job skills, no nothing. If they weren't working in law enforcement, they would literally be flipping burgers at McD's, or something.

If you don't believe me, just try to have a conversation with one of these guys. Actually thats not a good idea. Don't do that. It just pisses them off, if you do that.

You don't seem to have a very high opinion of our armed forces personnel and veterans.

Yeah, we all know that only the smartest and most educated people, who have at least a university degree, ever choose to join the military. The US Armed Forces would never accept anyone with just a high school diploma.

Anyway, if you want a paramilitary police force like what we have , thats the way to get it. Recruit from the military.

Smart and educated are two different things. You can't educate stupidity out of someone, trust me.

If that's the case then maybe they should raise the bar a little  this batch is proving dumber than average.

It's felony menacing. In California to be charged with assault with a deadly weapon, you don't even need to fire it. You obviously don't know much about the laws. Why don't you call the police over to your house. Then open the door with a gun in your hand, and see what happens. Since you are so sure you know what the law is.

Not in your own home it isn't, so long as you're not pointing it at someone or making threats. Heller and McDonald firmly established the right to keep and bear arms within the home, which includes having a weapon in your hand while answering the door, and 'menacing' in the legal sense requires intent to cause fear. Makes your barb kind of ironic.

Isn't the whole point of this thread that the police overstep their authority and use deadly force when it is not appropriate? In that light, how does the fact that the police are likely to overreact to a situation in any way support your mistaken view of the law?

As mentioned, its about Austria/Germany. Normal policemen get here training for de-escalation. So shooting is for them the last possible options. If they dont do so, they get into trial. For situations that dont fit into the "last possible option" training like armed kidnappers, bankrobbers, ..., we have special forces, so such stuff is regularly not done by normal policemen.

I never fail to be disappointed in that America continues to insist it has absolutely nothing to learn from other countries.

what would the german citizenry do if there were such a case as the Wii controller shooting over there? in America, nobody outside of family and a small circle of friends seems to give a damn. phil ochs in 1968 sang about American sheeple's self-righteous self-interested passivity in the face of such oppression ["outside of a small circle of friends"].

If it gets Media attention - most likely it would - the mass opinion of the people may have some sway over the Courts, If something is truly viewed as a grave injustice amongst the People, they will protest, march, picket, usw. usually until something is done to address the issue.

You've never known my parents. They were of the opinion shoot first, and to hell with the questions! When they said "Jump", you responded, "How high?", then did the deed. If they said "S***", you responded "What color, consistency, and where do you want it?"

I'm curious as to why they went with that saying :)

Because they demanded 100% obedience 100% of the time. There was no questioning them on why something needed to be done. You did it, or else!

Part of that mentality was from mom's side of the family. Grandpa was a WWII Army veteran. He, and his father, were the town drunks. As a mater of fact, great-grandpa ran a notorious speakeasy. He and his son were quite vicious.

While dad wasn't from a military family, he had a brother that was a Marine, and a hard ass, to boot.

An xbox or ps3 controller could probably get you smoked too. Many of them are black, most are wireless...I have a camouflage 360 controller! Wouldn't want to answer the door with that in my hand!
