If he was concerned about Floyd's health and his airway, why didn't he desist and administer CPR or artificial respiration, or put him in the recovery position with space to breathe? He was a police officer on active duty and he was bound by law to administer first aid, as well as to "serve and protect".
Death happens when oxygen can't be delivered to the brain. Crushing a man's trachea and refusing to stop when he says he can't breathe is virtually "guaranteed" to kill a person, especially when you do this on purpose, for no necessary reason, and you know he's in medical distress because it's restricting his breathing, but you continue anyway.
This, coupled with the fact he knew the suspect and had reason for malicious conduct, will be very damning in court.

And it's that total lack of any care for the man's life that facilitates the current murder charge. But I would not be confident of getting the 2nd degree to stick, needing that proof he set out to kill him vs simply not caring if he dies. If the knee was across the throat I'd say it's an easy 2nd degree charge, but it's not.
I can't 100% say he set out to kill the man. It's obvious he wanted to do him harm, but did he want to kill him?
