Ohio Judge Deems the State's COVID-19 Lockdown 'Arbitrary, Unreasonable, and Oppressive'
The ruling says the state's top health official exceeded her statutory authority by ordering "nonessential" businesses to close.

Ohio's COVID-19 lockdown is illegal, a state judge ruled today, because it exceeds the powers granted by the statute under which it was imposed. Responding to a May 8 lawsuit filed by the 1851 Center for Constitutional Law on behalf of 35 gyms, Lake County Court of Common Pleas Judge Eugene Lucci enjoined Ohio Department of Health Director Amy Acton from penalizing the plaintiffs or similar businesses for violating the lockdown, provided "they operate in compliance with all applicable safety regulations."

In issuing her business closure and stay-at-home orders, Acton relied on a statute that gives her department "ultimate authority in matters of quarantine and isolation." Lucci concluded that Ohio's lockdown does not meet the legal requirements for "isolation," which is defined as "the separation of an infected individual from others during the period of disease communicability," or a "quarantine," which is defined as "the restriction of the movements or activities of a well individual or animal who has been exposed to a communicable disease during the period of communicability of that disease." A quarantine is supposed to last only as long as "the usual incubation period of the disease"—two to 14 days, in the case of COVID-19.

By contrast, Lucci writes, "The director has quarantined the entire people of the state of Ohio, for much more than 14 days. The director has no statutory authority to close all businesses, including the plaintiffs' gyms, which she deems non-essential for a period of two months. She has acted in an impermissibly arbitrary, unreasonable, and oppressive manner and without any procedural safeguards."

HoganWillig, PLLC (“HoganWillig”), filed a Complaint on May 13, 2020 in the U.S. District Court for the Western District of New York against Atty Gen. Letitia A. James and Gov. Andrew M. Cuomo. The Complaint arose out of Governor Cuomo’s issuance of his COVID-19-related Executive Orders, and Attorney General James’ enforcement thereof.

HoganWillig maintains that the steps Governor Cuomo has taken, and AG James has enforced, in an attempt to “flatten the COVID-19 curve” far exceed the Governor’s authority under Section 29-a of Article 2-B of the Executive Law, which Governor Cuomo has cited as his authority for issuing the Executive Orders. Further, we believe those sections of law are repugnant to both the United States and New York State Constitutions. Therefore, while our own circumstances necessitate our challenge of Governor Cuomo’s authority and Attorney General James’ enforcement measures, broader Constitutional issues concerning Governor Cuomo’s and Attorney General James’ disturbing abuses of power must be addressed.

I thought I heard that the CDC shared new data that the updated belief is that the virus doesn't do well with remaining viable on surfaces and/or isn't as capable of infecting people from contact with surfaces as previously believed?

THE INFECTION RATES IN U.S. GOING DOWN

Dr. Deborah Birx on Friday announced a “dramatic decline” in coronavirus deaths and hospitalizations across the country, particularly in the New York City metro area.

"A dramatic decline across the states" has also been seen in the positivity rate, as testing capabilities are expanded, said Birx, the White House coronavirus response coordinator, during a briefing with reporters.

Birx called out three metro areas where the positivity rate has either stalled or increased: Washington, D.C., Baltimore and Minneapolis.

She said D.C. has the "number one" highest positivity rate of any metro area in the country, adding that "went through their logarithmic phase and are now at a high plateau with an unchanging number of cases day over day."

With regards to testing, Birx said that every state had met the 2 percent threshold to begin reopening as laid out in the White House guidelines.

Birx also encouraged people to go outside this weekend for Memorial Day, but urged them to maintain 6 feet of social distancing. She said it was acceptable to even "consider sharing social distance space" with those outside the home, with the right precautions.

This is what I expected. COVID-19 is a seasonal virus. As we transition into Springtime, the viral load will begin to dissipate. But in many parts of the States, springtime this year has been slow in coming.

In the United States despite how weirdly symptomatic COVID-19 has been it has followed a typical epidemic pattern of peak and decline. In addition generally the warm weather states have had both less restrictions, faster reopenings, and less disease. The weather does not explain Brazil, India, and Mexico being current hotspots.

This model does not take into account or is just not predicting a possible second wave that has many epidemiologists spooked and that the press has latched onto. Which means if this model is correct there are going to be a lot of unnecessary restrictions. A few universities have already said no campus learning in the fall. Most are scrambling to come up with plans to deal with the difficult if not impossible task of social distancing in a school settings designed to promote socialization. I have seen ideas of staggered schedules, on day online, one day offline learning.

Japan’s state of emergency is nearing its end with new cases of the coronavirus dwindling to mere dozens. It got there despite largely ignoring the default playbook.

No restrictions were placed on residents’ movements, and businesses from restaurants to hairdressers stayed open. No high-tech apps that tracked people’s movements were deployed. The country doesn’t have a center for disease control. And even as nations were exhorted to “test, test, test,” Japan has tested just 0.2% of its population -- one of the lowest rates among developed countries.

Yet the curve has been flattened, with deaths well below 1,000, by far the fewest among the Group of Seven developed nations. In Tokyo, its dense center, cases have dropped to single digits on most days. While the possibility of a more severe second wave of infection is ever-present, Japan has entered and is set to leave its emergency in just weeks, with the status already lifted for most of the country and likely to exit completely as early as Monday.

There is a dual nature to seasonal patterns: Winter with low humidity levels and summer with high humidity levels. In the winter months when humidity levels are low, the virus particle dry out become light and float through the air. We breath them in, the particles absorb moisture in our throats and rehydrate, beginning the infection cycle. In summer months when humidity levels are high, the transmission pattern is generally spreading the contagion by touch.

Refer to Table 1 in Seasonality of Respiratory Viral Infections

So tropical (hot/moist) weather does still play a role and create hot spots in places like Brazil, India and Mexico. But the transmission is through an alternate infection pathway [fomite, direct and indirect contact].

The best way to minimize viral transmission is to maintain indoor humidity levels between 40% and 60% RH.
