so a child should suffer more than an adult in the same situation? that's evil in my oppinion.

Of course it's evil. Especially since children aren't fully developed. They aren't mentally, emotionally, or physically as mature as adults. They don't know right from wrong as well as adults do.

Logically speaking, an appropriate sentence should be found for an 8 year old. Simple as that.

In Arizona, CPS makes every effort to "keep the family together". It doesn't matter if the child is being abused, or if the parents are using drugs or alcohol, CPS still tries to keep the family together.

That poor boy probably thought he had no options available to him and planned to escape the only way he knew how. He tried to do the right thing and tell someone, and no one listened to him.

When I was being abused by my parents, I felt trapped. There was no one I could tell, and if I did tell someone and they didn't help me, my parents would have made my life even worse than it was. I thought about killing myself, even planned how I would do it, but fortunately my religious beliefs stopped me. I also thought about running away, even started packing, but realized I had no place to go and unpacked again.

The kid gets to live better than homeless people; and what's more, he gets to live, which is more than can be said for his victims. And while he lives, he will always have the choice of self-improvment, which is another thing he denied to his victims. Finally, if he does become fully rehabilitated, he can become a contributing member of society, which is yet another thing he has denied his victims.

On top of all that, he gets three square meals a day, a place to sleep, free medical, free dental, and a free education all at the taxpayers' expense.

I'd say he's getting off easy.

Relatively speaking ... it sure beats a cold, dark hole in the ground ... or death row.

So do you give the child full responsability of what happened? quite frankly, not only that seem to be somehow cruel, considering the circumstances, and doesn't look much like an unbiased position about the whole situation, rather the opossite. One of the issues I see in this case, a part from the abuse, is about the weapon, as long as there is a fire arm near a child, which they can easily reach, there is always the danger of something like this to happen, I could say that lots of kids that had attacked someone because of anger, which happens a lot and is considered normal, could fall into a similar situation if a fire arm is near by, that's my opinion although I am quite certain of the possibility.

I wonder if anyone will now see that spanking is child abuse. It's also in a way sexual abuse, since a person's behind is close to their genitals. So really, it's pretty close to a form of rape, someone taking your pants down and manipulating you.

I guess next time I see an animal spank their child, I can say "I hope he has the sense to kill you like that boy in the news" Well that is what I would want to say to them, I imagine if someone can be that sadistic towards a child, there's nothing stopping them from physically attacking another adult either.

That's highly unlikely, and something of an unfair generalisation. To compare anyone who has ever spanked a child with some kind of sadistic rapist is insulting, wrong and ret*d. There are thousands of children (of roughly my age or thereabouts) who received a slap as a means of discipline at some point in their youthful careers. There are whole generations of people who were regularly subjected to corporal punishment at home and school. How many of them went on to slaughter their parents? How many of their parents were sadistic abusive child rapists?

And you have a fairly odd take on what constitutes sexual abuse, I might add. If someone kicks you in the nuts in a fight is that sexual abuse, or just fighting? Glad to see you encourage patricide in toddlers as well.

Did I bring up the term rapist in what I said? I said it's CLOSE to a form of rape, I didn't CALL it rape.

How many of those kids do you know weren't held in such terror that their only resort would be to disassociate, or end up with another mental pathology attributed to abuse. People have developed multiple personalities, so one personality copes with the pain, while the other one dissassociates, you call that a healthy result of parent to child aggression?

I don't encourage patricide in toddlers. However, since you assumed that of me, I'm wondering. Do you encourage parents to take their aggressions out physically on their children? Do you believe that children really just learn how to cope from a situation, where they have to always make sure they see mommy or daddy is in a good mood, or else they'll get hit?

If it was a woman in an abusive relationship, would you be so quick to side with the abuser? This is worse then that, it's a defenseless child, who depends on their parents. A child left in terror of those who were supposed to care for him.

One more thing, people who call other people or their views ret*d, are just displaying how they behave in a manner that would be considered ret*d. Lack of social skills, knowledge of behavior towards others.

You are very quick to assume that all "spankings" are Adult aggression being taken out on weaker individuals, or only ever results from a bad mood. As I said, thousands (millions perhaps) of children grew up with corporal punishment, and very few ended up psychotic because of it. You assume that every child who ever got spanked grew up terrified of their parents, when you can see people saying that they arent and weren't right here in front of you.

Nor is it generally comparable to other domestic abuse. People have already mentioned that without enough extra detail, there can be no way of knowing how abusive this "spanking" was. Hands? Fists? Belts? One clip round the ear or daily beatings for an hour? What had he done to trigger the punishment? Anything? Nothing?

You are very quick to assume that all "spankings" aren't done based off of malicious intent. There are thousands of parents who raise their children just fine without spanking, so therefore the point is made that it is unecessary to a child's developement. So now why would a parent participate in a uneccessary behavior, that could harm or hurt their child, unless they were getting some thrill from it?

We're not talking about a little slap on the behind, which I'm sure in your fantasy world, is as far as spanking goes. We're talking about parents who pull a child's pants down, who pull a child's underwear down, and hit them. You want to pretend because it's put under the guise of discipline, that it's reasonable. The only difference between spanking and rape, is nothing is being put into the child. Even then, you can't be sure of that either, right?

You really are getting carried away with these definitions are you not? Why does "spanking" have to involve stripping the child bare? It doesn't... Punishments, by definition, are supposed to be unpleasant. I never said I agree with beating a child half to death btw, I dont. I just think that you're putting too much credence in the belief that anyone who spanks a child is trying to sexually abuse them.

Spanking is stripping the child bare. Now if you want to continue on fighting "No no no! It can't be true!", fine. Don't get upset if some of us perfer to deal with these horrible issues and stop them, rather than hiding behind a false sense of all is well in the world, like you apparently fighting to do.

Why are you so frightened of having to deal with the reality, that not all parents have the best interests of their child at heart? Does it ruin your comfortable fantasy life, in fantasyland where everyone means good and well towards each other? Perhaps you never grew out of the stage where children believe play pretend is real.

fnord, do you even know what prison is like?

what would a sane person who's lost everything prefer? the rest of their life in prison (as you've said he deserves) or a quick and reletively painless death?
i'd go for death, it beats suffering in prison.

you can't just say 'it's better than ----' as plenty of things are better than different things, if you were punched in the face would you say to yourself "well, it's better than being punched twice"?

also, as the boy's'getting off easy' would you prefer he got stoned every day by his inmates? you seem to be the type of narrow minded barbarian that would pay to see that.

I'm under no such delusion. I merely disliked the tone of your post, because of what it insinuated about the millions of parents who use corporal punishment who ARENT sexually abusingtheir kids atall, and would never dream of such.

well, just goes to show, spanking is a primitave tool of parenting that needs to be abolished. Hitting your child doesnt make them want to understand what they did was wrong, it just makes them hate you more.

I have to disagree with this. It worked years ago and it can still work today, the thing is you need to know the difference in spaking and beating, and years ago, the law wasn't involved with child discipline on the same level it is today, my uncle was wipped with a belt when he was young, but he never did anything to warrent a wipping again.

I was spanked numorus times, and I even had my mouth washed out with soap when I was a kid, if my brother or I mouthed off or did anything really bad, we where punished, and it worked, what ever it was that we did that caused the spanking, we did not do it again.

I hate parents these days who say "i don't want my kid to fear or hate me" Its not meant to be fear, it's respect for authority, sure the kid may hate the parent for a day or so, but it doesn't last! I felt that way bout my mom many times, but I would give her a hug the day after.

I even had a chat to a cop about this and he said that the crimial code of canada allowes physical discipline to a certian level, taking a kid on you knee and spanking their bottom is 100% fine, and he wonders why this form of disipline has dropped because crime among youths has been on a tremdous rise, because kids have no repect for their parents anymore.

Kids are stupid and not stupid at the same time, they will take advantage of anything that goes in their favor, the cop told me of many kids/teens coming into his office trying to file a complaint against their parents for spaking, the cop turned them away knowing that they most likely deserve it, or he knew that the kid want their parents to get in trouble. Most kids who do this do it on purpose to take advange of the system, they don't know that physical discipline is acceptable on moderate levels. The system is set up to protect kids from beatings and abuse, spanking your child's bottom or hand is hardly abuse.

did you ever do anything as a child that you regret now, or would you feel it unfair to be punished for something you did ten years ago so that you could suffer more?

if someone goes to prison and after release is cast off they are more likley going to commit crime again, sometimes either to survive or it's because it's all they know.

when it comes to punishment i think physical/emotional harming of a child is just plain wrong, spanking a child or sending them to bed without dinner can have disasterous consequences (as this article somewhat proves) whereas talking to a child can help ease them out of their habits.

most of the time when i was slapped or hit i didn't even know what it was for, how is a chid supposed to stop misbehaving if all that happens is punishment without knowing whay?

you can't just say ...

I am SO relieved that Justice in America is no longer under the authority of the Crown! For one thing, I can say what I want. For another, I do not have to take your ... "legal" ... opinions seriously. Third, whether you believe it or not, we in America are moving away from the barbarity of capital punishment, even in pre-meditated murder cases.

It's likely that the kid will receive a "Not Guilty by Reason of Mental Incompetency" and be institutionalised until he reaches the age of 18, whenafter he will be released under another identity to protect him from death-penalty advocates and other self-righteous w*kers. During his incarceration, he will likely receive all manner of therapy and protection, and receive holiday furloughs with his mum.

Whether you like it or not, he is likely to be spared the death penalty.
