Here is the catch. DOJ will only investigate bullying cases if the victim is considered protected under the 1964 Civil Rights legislation. In essence, only discrimination of the victim’s race, color, religion, or sex will be considered by DOJ. The overweight straight white male who is verbally and/or physically harassed because of his size can consider himself invisible to the Justice Department.

Apparently, the Justice Department is going by George Orwell’s famous Animal Farm ending: “All animals are equal, but some are more equal than others.”

“We can only take action where we have legal authority,” wrote DOJ spokeswoman Xochitl Hinojosa in a December 2010 e-mail to The Washington Times Water Cooler. She continues:

Solution.

Give schools not the department of justice the ability to file for a formal expulsion from the system, require a judge and treat it like a criminal trial.

Think of a made man in the mafia getting to dictate how laws will be enforced and what federal cases will be investigated. That's basically what Holder is.

Group of bullies: Student with neurological condition is a bully! he needs to be expelled!

Aloof administrator: really?

Aloof administrator: *gasp!* You're right! We better forcibly lock him in a small room for our protection!

stuff like this happened to me all the time when I was in school. granted the students were not usually involved, but bullies already take advantage of the safe schools act, they'll take advantage of your proposal.

Evidence would of course be needed, and it isn't the administrator who would be expelling the student.

As long as eyewitness account is considered evidence, it would be shaky ground. and what else would you use for evidence? most bullying in my experience is verbal.

Eh, expulsion would likely only be for continued physical abuse, the controlling of verbal and emotional abuse would have to be handled by teachers to be effective, and they would need training to identify such abuse.

Yep, the solitary white male syndrome doesn't end after school. The workplace.

Holder and the DOJ are probably trying to insert more bullies to try and track where bullies hang out! :P

Instead of a sociopath it's always some paranoid hand wringer instigating in my case.

Sociopaths think I'm one of them and sense the genuine danger.
That plus the know me from the gun shops.

Teach victims of bullying self defense. Worked well for me when I was a kid and had to deal with that bs.

What are you talking about? Treat it like a criminal trial, meaning expulsion would require actual proof. I wasn't suggesting a jail sentence or fines.
