Harris issued a statement saying she was making the unusual request to stop the measure filed by a Southern California lawyer late last month. The initiative seeks to amend the California penal code to make sex with a person of the same gender an offense punishable by “bullets to the head or by any other convenient method.” The distribution of gay “propaganda” would be punishable by a $1 million fine or banishment from the state.
“The courts, rightly or wrongly, treat the initiative as sort of the citizen right and they are reluctant to get involved in trying to get rid of it, at least in advance, by using the law to keep something from being presented to the electorate,” he said.

One nutter's perverse joke does not apply to all of America, and not even to all of California.
Right now, as the law stands, the Attorney General can not reject any ballot measure that has passed the initial filing standards. Thus, anyone who can pay the filing fee can expect to be given permission to start collecting signatures on a petition to get their proposal on the ballot.
(I doubt that many would willingly sign such a petition here in Cali. I also doubt that anyone stupid enough to propose this initiative would have the million or so dollars to organize and collect the needed signatures.)
Only THEN the proposal would be put on the ballot, at which point the citizens of California would most likely vote it down, considering how many LGBTQs and their families live here.
No, this has to be some sicko's idea of a prank, and I expect it to be unanimously rejected by the State courts.

I have absolutely no doubt that this idiocy would be soundly voted down in a landslide if it ever reached the voting ballot. That said, I wouldn't be so quick to judge this as just a sick joke, either. There are extremely fanatical individuals involved in the Anti-LGBT movement who live and breathe poisonous hate, and who believe the very thing that was on this ridiculous petition.
