Copy right is copy right. My face painting friends are VERY careful about what faces they can advertise. One friend got a letter from whatever company owns the rights to Barney the Dinosaur. It was no joke. She's a 65 year old grandma doing preschool party gigs. She had a picture of a client face painted as Barney on her little web site. The word Barney was no where on the page or a reference to purple dinosaur. Those lawyers came down on her like napalm.
The school I used to work at could have no copy righted characters used as decorations etc. Teachers used to put up Snoopy/Mickey Mouse whatever in the classroom. I don't know what happened, but district office sent a big screed all that stuff had to come down.
Oh, the girl was in an art challenge. It was a competition. That is why HBO got all snarky. Any art contest my daughter or I have ever entered, usually states no copy righted material/idea can be used. Even the stupid school fair posters the kids would do, if it had any thing like spiderman or an actual Pokémon character it couldn't be put up or judged.
Intellectual property rights is great sub specialty of law to practice. Companies will spend a ton of cash on it.
Had this been something for school and not seen everywhere, I doubt HBO would give two craps. Since the great unwashed can see it, it's a competition, that's why they pulled the plug.
Had the girl not been autistic, same s**t would have happened and no click bait article.
