HBO takes down art by girl with autism because it used ‘Winter is Coming - New York Daily News

Quote:
Winter came for a 13-year-old girl’s artwork after HBO lawyers balked at its use of a popular “Game of Thrones” catchphrase.

The teen girl, who has autism, was competing in Huevember — an art challenge that requests participants select a different color to feature in their works each day of the month — when she created the piece that irked HBO higher-ups, Johnathan Wilcox, the girl’s father, told the Register.

I'm sure this would fall under fair use/parody laws so it's very stupid for HBO to take it down.

Also- what does her autism have to do with anything? Is it just for sympathy bait? Come on, NYDN!

Who wants a start an art contest to make the most offensive drawing with "Winter is Coming" written on it?

The adding in autism just gets more clicks.

Copy right is copy right. My face painting friends are VERY careful about what faces they can advertise. One friend got a letter from whatever company owns the rights to Barney the Dinosaur. It was no joke. She's a 65 year old grandma doing preschool party gigs. She had a picture of a client face painted as Barney on her little web site. The word Barney was no where on the page or a reference to purple dinosaur. Those lawyers came down on her like napalm.

The school I used to work at could have no copy righted characters used as decorations etc. Teachers used to put up Snoopy/Mickey Mouse whatever in the classroom. I don't know what happened, but district office sent a big screed all that stuff had to come down.

Oh, the girl was in an art challenge. It was a competition. That is why HBO got all snarky. Any art contest my daughter or I have ever entered, usually states no copy righted material/idea can be used. Even the stupid school fair posters the kids would do, if it had any thing like spiderman or an actual Pokémon character it couldn't be put up or judged.

Intellectual property rights is great sub specialty of law to practice. Companies will spend a ton of cash on it.

Had this been something for school and not seen everywhere, I doubt HBO would give two craps. Since the great unwashed can see it, it's a competition, that's why they pulled the plug.

Had the girl not been autistic, same s**t would have happened and no click bait article.

*shrug*

Agreed, that is why I did not use "Autism" to label this thread

A trademark violation on "Winter is coming".

*sigh* It's a common saying that anyone can use. Your grandparents have used it a time or two when Fall was coming to a close and their grandparents have used it as well and only until recently does some media corporation call the shots saying no one can use it without royalties all because it was used in some TV show they own.

Any progress on trademarking "The" yet?
