Maybe they started with a lizard template instead of a snake. So the first thing they noticed was that it was a lizard.

There are other species of legless lizards, such as the Glass Lizard. Lizards have external ear openings and movable eyelids, Snakes do not. (Thanks, Wikipedia!)
