It's a really interesting case, but also a sad one. From an article I read it sounds like the law was misapplied rather than this man is protected under the law. So I expect charges to eventually be brought against him.
I saw video of this and the dude really doesn't deserve to have died and the guy shouldn't have gunned him down. By the time he comes out of the store his wife and the man are arguing. I've no idea who closed the space, but they were right on top of each other and if you saw a strange man in your wife's face shouting at her, wouldn't you want him away from her? He walks up and shoves this guy hard to the ground. But he shoved him, he didn't hit him, and he doesn't move in to attack the guy on the ground, he steps forward to put himself between the man and his wife but then stopped. He wasn't going to attack this guy, and then the guy pulls the gun and he backs off and the guy still shoots him. He staggers into the store and dies in front of his five year old son.

That's all it takes.
1. He was shoved to the ground.
2. Then the shover moved towards him.
Thus, according to the law, he is allowed to "stand his ground" and use deadly force against a perceived threat.

Florida is the same state that gave a woman a 20 year sentence for shooting at (but missing) her abusive husband after he trapped her in the bathroom and started beating and choking her ( which he readily admits to). She escaped, try to flee through the garage but the door was stuck, got her gun to flee out of the house, and fired a shot over his head when she encountered him in the kitchen.
The prosecutor argued the garage door worked when investigators tested it and could be opened manually with a lever on the rail but as a female those levers tend to be difficult for us to operate because they tend to be hard to reach and require a lot of strength.
She appealled and was given a new trial and the prosecutor then aimed for a 60 year sentence. Ultimately though a plea deal was made and she was given 3 years with time served and two years house arrest.
But a woman fires a missing shot at a man who had attacked her and was actively pursuing her anfmd gets 20 years, and a man looking for a fight shoots and kills a man defending his family, who pushed him to the ground, walks free. The word "justice" has no meaning in Florida.
Then there is the issue of Casey Anthony. If she lived on the west coast she would be in prison.

Well, here's the thing.....
First-of-all, why'd the man have to shove the other man, so hard, and to the ground? Why couldn't he have simply walked up to him, and said: "Excuse me, what's the problem, here?"?
Secondly, the man who pulled the gun, didn't IMMEDIATELY / AUTOMATICALLY shoot----and, yes, the black man backed-off, PHYSICALLY (after he initially moved-in, on the man on the ground----who knows, to do what..... to continue, presumably, shouting at him, or to beat him up?), but, my guess is, the men exchanged words, then, and whatever the black man said----IN ADDITION TO shoving the white man to the ground----is what got him, shot. We'll never know, for SURE, though, because there was no audio.
I feel they BOTH over-reacted. I feel the man shouldn't have been shoved so hard, and to the ground----AND, I feel it wasn't necessary to shoot the man, UNLESS, when the black man moved t'ward him, he started, say, punching and kicking him, or something like that.
I think it's quite possible that this incident was racially-motivated, on BOTH sides. I think it's quite possible that the black man was thinking "How dare this white dude talk to 'my woman', like that"; AND, I think it's quite possible that, like I've said so many times, before, that white people have begun to stand-up to black people, because they are sick-and-tired of what they consider being pushed-around by some black people.

My guess is that the shooter is a "hothead" or "bully" who likes to be in charge, and gets infuriated if someone challenges him. He probably shot because he was angry about being shoved.

I feel the same could be said about the black man, as well, though----that he's a bully----and, that's what I'm talking-about (that some white people are really sick-and-tired of being pushed-around (figuratively) by some black people).
I've seen incidents like this POSSIBLY could be, a thousand-and-one times, where a black person has just automatically assumed the white person is acting the way he (or she - I've had it happen to me) is, merely because the person he's reacting TO, is black.
Who's to say that the white man wouldn't have ALSO given a WHITE person who parked in a handicapped spot, without a Disabled hanger or license plate, the same talkin'-to----in FACT, the convenience store worker said the white man is a regular, and that he always goes-off on someone, who doesn't have a Disabled Pass (or license plate - in the video, it shows the white man going around back of the car, presumably looking for a Disabled license plate).
Yes, I know the black man backed-up----but, like I said, I would bet, almost anything, that the black man said something, that, in addition to shoving the white man, hard, to the ground, that was what got the black man shot. Again, I'm not saying what the white man did, was right, but.....

AFAIC, the people defending this busybody quasi-demented vigilante, have taken a cognitive detour into a moral abyss. the family NEEDS to civil-SUE the crap OUTTA THAT GUY - hey, if it was good enough treatment for a black guy [OJ] it surely is appropriate for this white dude as well, what's sauce for the goose is sauce for the gander. civilized people do not reply to a shove with lethality aforethought bullets. proportion, people, proportion. where is the dividing line- a simple slap justifies playing judge/jury/executioner?

Yeah that is because a man shot someone for shoving him. The guy parked in a handicapp spot...which he should not have done( I also am not sure how clearly it was marked) also it was just a very quick stop just to run in to the store...maybe they had been driving all day. But yeah the gunman waited till the man went inside then approached the vehicle to scream and shout profanities at the guys girlfriend and kids in the car. So he ran out ended up shoving the aggressive acting guy...who then pulled out a gun, which he then backed away towards the vehicle and he still shot him.
I mean what guy wouldn't be willing to shove some ass harrassing their girlfriend/wife and kids.....that is no reason to be shot dead. Also I hear based on comments from people that live in that area that the gunman had been hanging around that gas station picking fights with various customers for quite some time before that family arrived.
So yeah laws that allow for you to shoot someone dead, because you instigated a conflict and got shoved do need to be challenged. It was clearly not a case of self defense...how is it self defense to shoot someone who is backing away from your gun and is un-armed?
Some people defend this as, but he was old...well then he should have been old enough to know not to loiter outside a gas station to harass customers.

And maybe the white man said something threatening to the mans girlfriend and kids before he got shoved. Also the fact that the conveinence store attendent said that, if anything give evidence the gunman was a loose cannon that regularly 'goes off on people' at the gas-station. I mean if I was a gas station attendant I would not want some guy who regularly goes off on other customers hanging around the station. I'd probably call the police to have them removed.
Also getting shoved after acting aggressively towards a persons family is not grounds to shoot the person who shoved you. Especially if they back away, there are other bystanders and the persons small child is standing right next to them. I mean even if it was really justified to kill this man, really...right in front of his little kid?

So if someone shoves you to the ground, you should wait for them to start brutally kicking and trampling you, and only then try to reach for your gun, assuming you still have a working and not immobilized hand to reach for it, and the mental clarity to do it while receiving the blows, possibly to your head, right?
Something tells me noöne here is even trying to suggest a course of action that would be acceptable regardless of who followed it. Everyone knows whom to hate and is determined to make sure the target of their hatred can't win, while others would be judged in a completely different way.

I'd have had no problem with him gunning the man down if he was coming forward, but he never came forward. Also no problem if he drew the gun and didn't shoot.
You don't shove someone if you want to hurt someone. This guy wasn't looking to hurt him or he'd have sucker punched him. He wanted him away from his wife.
