Prisoner sues for pain, stress over moldy cookies

If he was vomiting and having diarrhea for several days why wasn't he admitted to the prison infirmary when he first started to get sick?

food poisoning should be compulsory for all prisoners, its not supposed to be a holiday camp you know. Actually why was he given cookies anyway- cookies!? what sort of punishment is that ffs? :roll:

I bet he molested hundreds of children, what sort of message does this send out? - Break the law & get rewarded with chocolate chips.

This means he's already being punished for his misdeeds. Which involve theft of some kind. And do not involve perversion.

This would indicate that he used his own limited funds (prisoners don't get to have much money) to buy the cookies himself. I don't think cookies are much of a luxury, myself.

I believe that the point is that he got the cookies at the only place available to him, probably overpriced, and that he did not inspect his cookies for defects before eating them. Do you inspect your cookies? Most people don't. I think most people have had the experience of finding mold in a partially-consumed loaf of bread. Do you inspect all the slices in your loaf before eating?

I don't know if this merits a lawsuit if the mold was hard enough to spot that he didn't see it right away, but I do think he MAY be entitled to something because the prison controls everything to which prisoners have access, and he was harmed. The prison is supposed to supply only non-deleterious food to prisoners. This is the same as requiring functioning toilets, heat in winter, etc. and is not pampering.

I do, because I've sometimes found mold, and I'm kind of picky about that.

And I'm not in a prison.

Not that I don't see your point; I don't think mold poisoning was supposed to be an explicit part of this man's sentence.

Nevertheless, something about this puzzles me; I just can't imagine under what kind of drug influence would I have to be to eat (I mean without noticing) a significant enough amount of molded bread to cause me continuous vomiting and diarrhoea.

^ He could have eaten them at night, thereby not noticing. A potent(toxic) mold combined with heavily spiced cookies which he had not eaten before might have prevented him tasting anything unusual.

that is only to be assumed.. but how many innocent people go to prisons, and get gangraped in there.. f**k I actually feel sorry for some of them. the punishment is supposed to be the prison term, not food poisoning..

prisons shouldn't be a bull ring, but that's what they become :x i don find it particularly charming.. a lot of non-violent people go to prisons too ya know.. people go away for simply hacking into someone's computer.. that's a completely non-violent crime.. should someone suffer hell and worse for that?.. what ever happened to forgiveness?

"wow these cookies smell funny and they are a little green.. but I'll eat them anyway and I am sure it will be fine"...or did he not even notice that?? I guess some things just don't occur to some people, sheesh (whether they are in prison or not)

Good point, I believe that people who advocate for severe punishment in prisons would think otherwise if they would be convicted while being innocent.
