Wow! That's a long video, but worthwhile. It points up a problem that we in the United States have with our law enforcement employees. They feel that they have an absolute right to do whatever they want to people they encounter. I believe that it started with the war on drugs, and has become a war against everybody.

I'm not sure what to do about it. Certainly cops with this attitude should be fired, but then there would be very few of them left.

Kudos to the person in this video, both for knowing and demanding his rights, and for filming this illegal activity.

First off, this kid is a fool because there is a supreme court case that allows for checkpoints and customs/border patrol now has a 100 mile area in which they are allowed to do their job (and you constitutional rights are not valid with customs/border patrol). If anyone has issues with this, contact your congresscritter.

In any case, all the person has to do is pass papers that sufficently proves they are US citizens. You do not have to answer any other questions and according to the supreme court, 20 minutes is the general rule for detaining someone without probable cause but as this person pointed out, you have to request to leave in order for your right to leave to be valid.

I am sure after 20 minutes, the superiors of these agents told them that they did not want a media case over this and to be honest, traffic was backing up and they were less efficient (with 10 agents on him, how many are looking at the other vehicles).

As for the recording, that he has the right to do too once they are informed that they are being recorded.

A couple things.

First off, **** the Supreme Court for allowing this to happen. Personally, I don't care about their "authority" to make decisions in direct violation of our Constitutional rights. My rights are my rights are my rights. That's it.

Secondly, you if you think the guy in this video is awesome, you should understand who this person is. Some of his other youtube clips...

Whether or not you think the Supreme Courts ruling violated the constitution, they are the final arbitors in determining whether such laws are a violation of our rights and their rulings must be followed by everyone in the USA, police and citizens. The check on them however is the fact that the legislative branch can pass a law (as long as the law is constitutional) to override the ruling and has done so on occasion.

I don't need a lesson on my government. The Supreme Court is supposed to be the protector of the Constitution, not the ones that tear it apart. They've basically gone completely against their mission statement, and as such, I don't recognize their authority.

They do not decide my rights. I'll say it again. My rights are my rights are my rights, regardless of what ANYONE has to say on the matter.

The consideration of this guy is 'awesome' or not is completely irrelevant as was you trying to hit piece him...when he is a nut or not has no bearing upon the sequence recorded in the initial video. I thought the idea was everyone was equal in the eyes of the law - by trying to attack his character one can only wonder what you're motivating impulse was...the issue is NOT his belief system but the the misappropriation of authority!!

@demeus - if you pay attention to the video it is clearly apparent he is very much aware already of the 100 mile rule ergo not the fool you claim him to be..

Unfortunately it's the trend here in Europe too - especially in Great Britain where the extent of powers granted to law enforcement are equally foreboding :(

It looks to me like this guy knew about the checkpoint beforehand and intentionally set out to collect footage of his rights being violated... he intentionally acted in a suspicious manner in order to get the border patrol agents to single him out... personally, I think he's a jackass... his behavior alone is enough to arouse suspicion, which I'm sure he is aware of...

The border patrol checkpoint was put there to do a job deemed necessary to national security, namely to prevent passage of illegal aliens. I would bet that the checkpoint is located in an area where if you're driving the road in that direction, you would have had to be either coming from mexico, or made a u-turn after passing in the other direction...

the fact that this guy only turns his camera on as he arrives at the checkpoint begs the question of what happened immediately previous to his turning on the camera... did he pass the checkpoint in the other direction first? Did he do something to make himself a target just to get this footage? Are there 3 mexican nationals sitting quietly in the back seat? We may never know...

people like this make it harder for the real freedom fighters to be taken seriously...

I thought it was weird when I encountered one of those checkpoints on the highway. I had been driving all night and the sun had just begun to rise.

I wondered if I had taken a wrong turn and was headed for Mexico. They stopped me and asked where I was going. I said, "Uh . . . . California. I'm still on the right highway, right?"

The guy just waved me on without saying anything.

I have to concur. Law enforcement at a checkpoint has the right to detain and search someone's vehicle if they have "probable cause," a search warrant is not needed to search a vehicle.

This guy was acting pretty suspicious.

You mean that asserting your rights in an encounter with law enforcement personnel is "acting pretty suspicious," giving them probable cause to search your vehicle? If we cannot assert our rights, then in fact we have no rights!

They're allowed to stop you and question you without probable cause. If you start acting like an @$$ because of it, it's going to make them suspicious.
