These have to be the biggest f*****s in exsistance they took my child away before it even left the hospital!! Just because i have aspergers they assume i can not look after baby? I have no History of any mental illness or anything. Sorry But i wont be talking to a single NT as long as i live. Stupid f*****s!! You need to get a lawyer and go to court to get custody back. I would also contact the paper or a news source and have them do a story on this.

I agree that is ridiculous, they had no right to do that.

While attempting suicide is not necessarily a sign of mental illness, it suggests you might have some problems in how you are functioning in life at the moment. As painful as it is to have social services take your baby, is it possible that the case worker was genuinely concerned that the baby or you might have been at risk. A person who is this quick to attempt suicide may also be exhibiting traits that might appear dangerous to her baby. It doesn't mean you are a bad person. It just means that the case worker had serious concerns and felt it was better to be safe than sorry.

I'm very sorry that you are going through a rough time and I hope this can be sorted out quickly. I suspect you can regain custody more easily if you can show the case worker that you are not suicidal and it is clear to social services that you are stable and capable of handling the difficulties of caring for an infant.

Don't you have a wife or girlfriend? I'm asking because I am surprised they take your baby if he has a mother. Do they still take the baby if one of the parents has AS and the other one doesn't?

Well my advice to the OP is to tell us what country you are in, the law differs greatly from one country to another.

I think you should talk to a lawyer,

As a lay person I would suggest that you consider a writ of Habeas corpus or some other writ which forces a court to discuss the case. You could go down the line of reasoning that the baby is illegally being held prisoner. Keep in mind that human rights which adults enjoy also normally apply to children.

The habeas corpus writ is a writ designed to force the state to produce the person and appear in court and then for a court to consider the continued detention of the person. I am not sure what will happen if a child which is too young to be mentally competant to answer questions has this writ filed on their behalf. This writ is normally used in the case of an adult who is being held against their will.

If you do not know exactly where your baby is being held you could consider as a publicity stunt to go with several members of the press to a police station and file a missing person report, this could kick up quite a stink. You could do this as a way of trying to get the state to be forced to conisder the legality of the detention of your baby. If you do this then do not go into a private room with a police officer, instead deal with the whole matter over the counter, if someone tries something then it will occur in the plain sight of your witnesses from the press.

Where's the baby's mom in all of this :?: If they took the baby away from you because she wanted full custody; there may not be much you can do about it because social services & courts usually side with the mom a lot more than the dad.
I would of suggested talking to a lawyer but I doubt going to court would help you because your suicide attempt that night will be used as evidence/proof that you have mental issues & they may even push to have you committed to a mental hospital. Do you have any relatives you are close with that may be willing to act as a guardian/get custody of the kid. Social services may think you are unfit to care for a kid/baby by yourself but they may be more open to letting you be involved with the parental role if someone else is helping you & officially taking charge. It's not uncommon here for grandparents to get custody because their daughter isn't fit to be raising her kids; the moms are still around the kid a lot sometimes & some even live with the kids grandparent so the mom can still take the mother role in the kid's life even thou the grandparents officially have custody

Wait, this happens? Oh s**t. I want to have a baby, does that mean social services will take it away from me? I would be soo upset. Definitely fight it.
