Banned from the library .
At this point I am banned from the San Francisco Main Library (which has been the one I used) , and presumably all branches , and if an appeal does not go right , I will be banned for a year !
It all comes out of a female library guard , feeling I was not paying sufficient attention , physically touching me , poking me ! !!
If I am barred , I really will have to leave San Fran ~ At my level , I cannot not be able to use the library , certainly I an not really Web-communicate without it ! If I do , then...For lack of money t o go to New York , and lack of connections/an invite anywhere else , perhaps I'd go to Santa Cruz ~ AGAIN ~ hoping to somehow put things together t here to , well...........I am at an Apple Store now . I can hardly get keyboard time in like I even could at the ML , so
...........

How did it even get this far? Under the ADA(Americans with Disabilities Act), you are clearly a protected class.
http://www.ada.gov/regs2010/titleIII_20 ... ations.htm
One area specifically specified that is to allow access to you regardless of your disabilities is public libraries.
Touching you, and poking, is not proper. If her demands were excessive, or you could not respond, you could concievably turns this case around to her.
If you have documentation on your having aspergers, it should help make things even more certain, but you qualify for the ADA, etc... On the basis of the other stuff. If they banned you because of something like the COPD equipment, for example, things can get really bad for someone there. Let them know about your conditions and need, and check out the info here: http://www.ada.gov/
San Fran is really cracking down on the homeless. I doubt it is the guard jumping that fueled this, but a whole list of petty complaints. The guard jumping just gave it enough cred to push the paperwork through.
When my city's library became more "family friendly", is when they ramped up making the homeless unwelcomed to camp out from open to close. It didn't help that a man was taking a sponge bath in the rest room sink when a group of boys walked in. It doesn't help that there is a huge Salvation Army shelter down the street and a mega church that runs another. So there is very little sympathy for anyone homeless, because people believe homeless should be washing up in shelters and not public bathrooms.
I get why people.dodge the shelters, unfortunately I am in the minority in that belief.
ASS-P do you have a copy of the complaint? Usually to remove someone, they say you have been aggressive and uncooperative. I wonder if they have been keeping a log of interactions with you. My library does to bring a case against a person to ban them. Here that is mostly panhandling in the library or washing up in the restrooms and not letting anyone else in. Right now the stall bathrooms are locked, and the single unisex ones are open. Makes it easier to keep tabs on people, I guess.
Hope this turns out the way you want.
I hunted around to see how the SF libray issues violations.
http://sfpl.org/mobile.xhtml.php?pg=2000002001
Severe Violations Level One.
(I'm guessing this is your charge. The others are exposing yourself or branishing a weapon.)
Engaging in physical altercations including assaults and fighting.
Cal. Penal Code (“CPC”) § 415; CPC § 242; CPC
§ 245.
There is a huge gap between *I just jumped* and the above. I don't know what went down, but jumping back from guard doesn't scream the a level one severe violation.
I would STRONGLY suggest to hype up the Autism angle for all it's worth during this hearing. I don't know how loud you got, what you said, how you acted, but the staff felt threatened enough to file it. I wonder if you can bring someone for moral support.
I found how the arbitration meeting works.
http://sfpl.org/pdf/about/commission/ar ... 041714.pdf
It's a PDF, and I'm on a mobile phone. If you Google the first part, the article should pop up.
Nutshell..
You get 15 minutes to plead your case.
Staff gets 15 mins for their side.
You get a 5 minute rebuttal.
Whatever decision is made is final.
I also looked up Santa Cruz Library. They are even less friendly than the SFPL.
Tawaki made some great points. I still sometimes tend to be a little too optimistic with regard to how complete a story is, and don't generally think about the homeless angle.
If your hygiene is really poor, you need to fix that ELSEWHERE, and it could hurt your case.
If you were violent, my earlier suggestion STILL goes if you didn't cross a line, they started it, and you can tie it to your disabilities.
15 minutes isn't that much time, especially if they are the second ones to respond. That puts you at two disadvantages. They can shoot down your case, and you may not know theirs.
Technically, you have a right to know their course of action, so push a little to get it. It will limit some of their advantage. Also, try to anticipate everything, and counter every point. Don't try to explain anything they don't refer to.
I am not, personally, homeless but do deal with them, do hear their legal troubles, do not want trouble.
I pay better attention to my hygiene, and make sure to carry an ID. I rehearse lines, in case anyone asks.
In my town, they are offered a choice between "help", physical relocation, or vagrancy charges, but you're not staying there.
When you get to the hearing, make sure you are wearing clean clothes, and that you showered. I might even consider shaving my beard, and cutting your hair.
Also, make sure you present your case in a rational manner. Make sure you say something about how the library benefits you intellectually, and that you don't want to lose this way of improving yourself. Kiss a little butt.
What exactly did happen with the female guard? When will the hearing occur?
...BRIEFLY: (1) THE GUARD + LIBRARIAN TALKED IN A WAY MAKING IT CLEAR THEY , REALLY , DIDN'T LIKE ME .
(2) (I don't have time to erase the capitals , I'm at that Apple Store again .) They cut me off from defending myself to them , saying " Shut up ! (Or similar) We don't want to hear from you ! "
(3) The guard called the police when I was already , as told , packing up to go ~ Not fast enough , I guess .
(4) Since po-po were there , and she apparently inflated it to " He hit/slapped me " , she could haAVE had be arrested ~ but she didn't . Hamm .

,...Another encounter with library personell mde me believe they're constructing lie-s to try and win and get me thrown out .
If I am , I really can't stay in SF , I have to have Internet access . Ii had , when I had the regular library access , spent too much time here - It's nice tp express myself , and to let things out , but , even with the nice praise from those who liked my viewpoint - All my comments didn't lead to a lot of help for me
, and I have repeated a lot . (On another level I guess I spent somewhat too much " fun " time on Facebook , too - where I am not out about being HL - and messing around w-my YouTube feed .)
IF I don,t have regular , convenient , internet access , that is , practically , like not having access to the city water system
. If I went somewhere I'd really like to go to NYC and see my brother , as I have said , or some place new to me
- But I certainly don't have the money for the former , or help and suggestions for the latter
.
Writing such important stuff as my money payments and the CCSF attempt needs , really , steady access to a strong , big , computer , where I can do the , more formal than this , carefully written writing those subjects need
.
s forr the latter ![]()

...I went out yesterday and bought some stuff at an outdoor store , you could see , especially , the vest w/a lot of pockets as " homeless gear/something to be HL in " - Now , really , being HL really won't be that comfortable , as I always find out every time I do it !
But , to narrow it down , WHAT I AM SUPPOSED TO DO , minus regular computer access at the library
?
Yes , I am doing some other computer-ing right now ~ It is not as much as the regular , convenient , availability of the nearby , sturdy , library computers !
If I got more outdoor stuff , I was , having read that Sports Authority is going bankrupt , hoping for a cheapo close-out sale - Especially if I could get some extra funds - Even a loan , whbich I'd repay ??? ![]()

Call 415-989-1616
between 8:30am and 5:30pm
Monday - Friday.
That is the Justice & Diversity Center Lawyer Referral & Information Service, of the California Bar Association, hotline.
When you call, tell them that you have a disability/discrimination issue and you are injured (that word has a broad definition with lawyers). "Injured" callers get a free referral and half-hour consultation with their lawyer - and you fit the criteria.
This one phone call may provide you with a lot of help, because this is also the line you call to determine if you are eligible for a pro bono lawyer. Free anything usually has a little bit of a wait, but free legal services usually aren't once you qualify - I guess it's the nature of the work.
I hope things start getting better for you.

...First briefly factually?? answering KK , the respite place is meant as temporary , anyway , not permanent , and , at least an indicator or two that I might be seen-will be as " having gotten better " by the places staff (especially as my problems are not so visually apparent - Well , aside from my 7&1-2 toes , and thats permanent
.)
