Falsely Ticketed by #^#$^ Cop. Twice.

Even though it has been a few days I am still fuming about what happened to me. After almost 20 years of perfect driving I was charged with two motor vehicle offenses by lets just say a little Hitler cop. Even though I saw the Stop Sign and Police vehicle, I was pulled over and ticketed for "running a stop sign". After calming down, I returned to the scene, parked, and took some pictures that almost prove the cop could barely see the intersection. I then return to my vehicle, pull up to the stop sign and wait three full seconds. I sarcastically stared at the officer and he pulls me over again and tickets me for running THE SAME STOP SIGN! How I was able to resist doing something criminal is beyond me but he lied to my face and denied he was parked in a parking lot even though I TOOK A PICTURE OF IT!! He then had the nerve to tell me I was "lucky" because I am a repeat offender despite the fact I didn't even get a chance to enter a plea on the first ticket.

So, after all these years of being a rules-obsessed Aspie I am facing a hefty fine, significant points on my license and a major insurance increase. All because I followed the provincial traffic laws to the letter and stopped at the actual stop line (the intersection is several feet ahead). I use to trust and respect the police but now consider them an untrustworthy enemy and spend more time looking for them than watching the road.

On the plus side, my encounters with the court staff have been excellent. I couldn't believe how easy and efficient it was to enter a plea and request disclosure from the Crown: I did not expect such excellent service. Did I mention the cop is a 15 year veteran and a trained hostage negotiator? Considering he refused to listen to my explanation and talked to me like a 12 year old, I wonder what kind of demotions he must have gotten to be giving out traffic tickets. I am out for (metaphorical) blood and as someone obsessed with justice this drives me crazy to think I could be convicted just based solely on his lies. :-x

I really hope the judge will look at this situation and laugh it out of court when I show them my evidence. He picked the wrong guy to mess with.

It's possible that the tickets will be dismissed, depending on the judge. Definitely fight this.

If they offer a plea bargain with no points on your licence, and with the insurance impact of a parking ticket, I would take it.

You have a**hole police----but you also have decent police, too.

so....you were taunting him? why else would you "sarcastically stare", and why cross the same (?) intersection again....

some usually stop behind the line, then creep up to where they can see better, then they cross. that's what the DMV likes here in CA, i guess that's what the cops like too.

if it's not a four/all way intersection, it can be dangerous to stop behind the line and then go, even if you can't see traffic coming from the sides.

Well hopefully you can get a more fair decision in court.

However for future reference, don't 'sarcastically stare' at cops or do anything to aggravate them and don't argue with them....if they do something wrong you can bring it up after the fact in court. Also are you certain you actually stopped and didn't just slow down and go at the stop sign?

Consider getting a dash-cam, video could be very useful when appealing any future alleged incident or violation.

Request a hearing.

Try to get a plea bargain down to a no-point violation. Make sure it doesn't affect your insurance.

Yes, I am 100% certain I stopped the first time. I stopped well before the stop line because it was very icy at the time of the first incident. To be fair I have almost no experience with police: my only other time was 4 years ago in another part of the city and I believe it was this very same power tripping clown. He even had his hand on his gun too! For traffic stops in Canada? Get real.

No, I was proving a point. In other words, there I stopped, are you happy now you petty, power hungry cop? I had no emotion I was just making it obvious to him I stopped properly and followed the letter of the law. Even if I WAS "taunting" him by stopping too long to prove a point, that's no reason to ticket me for NOT stopping. As for why I was there again, I have a right to leave my home and drive on my own street. What else could I do? Not leave home?

I had a clear line of sight (unlike the officer) and took the photos to prove that so I didn't need to stop again and there are literally no cars or pedestrians anywhere. I suspect he ticketed me again as revenge for taking perfectly legal pictures of the scene. For the record I was extremely polite and respectful the first time and did not disagree with him but the second time I could not help yelling "oh come on! I stopped!" like any normal person would have. I quickly know it was like talking to a wall with him and threw my hands in the air because he was clearly blind as every other driver didn't stop all the way while I was gathering evidence.

I just found out he has had two excessive force lawsuits levelled against him so I know it's not my imagination he's power hungry. Any judge should see that it's a bit strange that someone who has driven for over 17 years would have two tickets on the same day from the same officer in the exact same street. Either way I have already compiled a massive file and will fight tooth and nail because it royally pisses me off to be treated this way.

To be fair, it is usually the older cops in my city who are corrupt. The younger ones generally seem very polite and helpful and I shouldn't judge them all like this guy. I saw a few younger guys and exchanged pleasantries. After all, my horrible boss is no reflection on me as a worker.

Don't go out of your way to irritate a cop or show him up. Unless you want outcomes like this.

I do think you should contest the tickets, but I also think in future, you should avoid getting in conflict with petty, power hungry officials. You could end up with another one of their "excessive force" situations.

I felt skeptical when I read the first few posts, and agreed with the people who warned you off annoying cops. However, you seem equipped to effectively fight this, and someone needs to, so I say Bravo!

i was once booked for driving the wrong way down a one way street. but the sign painted on the road was written upside down.

i hate it when a sign says no "U" turn, so to get around that i always make sure i make a "W" turn instead.

if you get fined for going over the speed limit, then to be fair, you should be rewarded for going under the speed limit.

if that were the case, i would park my car all day between 2 speed signs and make a healthy living.
