My USDoEd student loan is in default and is in the hands of a collection agency. My past two federal tax returns have been eaten up by this loan - a total of about $3,200 (+/-). My total debt to this lender; $1,400 (+/-) and they're still claiming I owe them the same amount I did two years ago.

I'm thinking I can't just contact the collection agency directly and accuse them of fraud or embezzlement. I'm thinking I should go to the IRS or the DoEd something.

Thoughts?

So your debt a few years ago was $1400, and they've taken $3200 from tax returns and still say you owe $1400?

That does seem kinda excessive. I know interest is a nightmare, but typically student loans have real low interest rates. And I thought once a loan goes to a collection agency it no longer accrues interest? I dont know though, not familiar with how collection agencies work. I had a credit card I defaulted on like 8 years ago and it went to a collection agency, owed like $500, I never did anything about it until a few years later, ignored the collection agency letters, but finally paid it off after 2 year or so, and it was the same amount. (was $300 originally in credit charges, added on a few months of late fees/interest to around $500 and then it went to a collection agency, and it never went up from then).
But credit cards and student loans are two different animals.

Have you called the agency at least to get their side of why you are paying so much? Maybe they are jacking you with a 25% interest rate or something.

You may want to use findlaw.com and find a credit attorney

When in doubt, ask an autistic. Chances are, they're obsessed with what you need to know.

I don't know how that thing works, but I'm assuming it's like a credit card.
Are you paying the minimum monthly payment? Or are you doing payments to capital?
What's the APR (interest rate)?
