Venting
Ok, Here is the place to vent. What has you most flabbergasted or steamed lately? Anything really annoy you?
I'll go first. I was fired from a job in November and they denied my unemployment insurance. The court initially upheld my unemployment benefit. The company appealed this and I lost the appeal. I appealed that and was just notified I lost.
Here's why....
I was working as a nurse and we keep patient notes electronically. The VP at my company wanted me to keep written notes as well so she could keep track of my work. I was in a management position and explained to her that this was redundant as I was already keeping electronic notes and could also be a HIPPA violation if anyone without a valid need were to access those notes. Each violation is a $50,000 fine and possible jail time. (HIPPA is a law that protects patients rights, in simplified terms, only people who are involved in the treatment process of that patient are entitled to see their medical record, including my notes) At any rate the VP got mad and fired me. Here is the gist of the legal findings from the last appeal letter.
The company was within their rights to ask me to make written notes as well electronic ones. Doing so it would be my responsibility to insure and protect against HIPPA violations. The company was also within their rights to fire me for insubordination for not immediately leaving the premises when initially fired. (I refused to do so until I had secured the open patient records on my computer so as to safeguard against possible HIPPA violations and protect the privacy of the patients I had just spoken with over the phone.
Thus, I should have made written notes, but if I let the VP read them HIPPA would have been violated but according to the finding I not the company would have been responsible because it was my responsibility to safeguard the patient's confidentiality. I also should have left immediately after being told I was to be fired rather than insisting on being able to secure patient files, as failing to do so was unreasonable on my part and secondary grounds for my dismissal, even though someone else would have had to secure my computer and unless they had a relationship with the patient their reading of any of my notes would have constituted a HIPPA violation for which the company could have reported me and for which I could have been fined, jailed or were I still an employee, terminated.
I've never heard such a load of catch 22 rubbish in my whole life.
UGGGHHHHHHhhhhhhhh.
OK...
Done Venting.
Next?
^ That sounds horrible. Isn't there any further action you can take to make them do the right thing? That kind of unfair decision disgusts me. Their treatment of you seems harsher than necessary. I get a feeling there's more to the firing of you than just the issue with written notes, such as a simple personal dislike, discrimination etc. I mean I know nothing about your situation and I might just be imagining things. Any way, I'm so sorry that you are going through such a horrible situation.
Mine:
It's much smaller compared with the OP but it's been bugging me a bit. Simply put, it's a nasty doctor. When I saw him a few weeks ago, I felt bad vibes from him, as if he didn't like me. He was smug, dismissive and even snorted at what I said, as if I were stupid or faking a symptom. It's meant to be a bulk billing clinic (free of charge) even for the blood tests. However, doctors can arbitrarily make the patient pay for the blood tests. And he did make sure that I pay for the blood tests. Other doctors in the same clinic are not like him. I'll never see him again.
I have had far more bad experiences with the people from those regions of the world than with others. They are often smug, arrogant, "superior" and unkind. The above doctor is also from around there. I don't conclude based on those bad experiences of mine that all the people from those parts of the world are like that, but it makes me wonder what makes many of them behave like that. Yet they are the ones that often complain about racism.
